<div>My wife failed her last semester of her RN class. She passed all tests but one and also passed her HESI exam (which is what the college uses to measure the students ability to pass state boards). Obviously, she appealed her grade. The instructors reviewed each test after completion, made adjustments, sent out rationales for changes and the testing ended with the final. At that point, several others began appealing the test that my wife failed (a large percentage of the class failed this same test). The instructors went back again and adjusted some grades on at least two tests and declared these same tests &#8220;thoroughly reviewed&#8221; again. Thankfully, this caused many others to pass, but put my wife literally one question away from a passing grade. She appealed again to the department chair. (but my question is not directly related to this)</p>
<p>Meanwhile, to be a good sport, my wife decided to help assist with the pinning ceremony practice of the passing students. When she arrived, she was approached by the department chair, who asked her name. My wife told her and the department chair promptly told her that she could not be there. My wife explained that she wasn&#8217;t there as a participant, but rather to assist as needed. The department chair again told her that she needed to leave. </p>
<p>My wife has trouble being admonished by authority figures. She is a very capable LPN and has won many accolades for her work. This event, couple with her near miss, upset her emotionally. So badly, that while at the doctor&#8217;s office later that day (pre-made appointment for reupping some meds), the doctor told her that she did not need to work in the state that she was in and gave her a doctor&#8217;s excuse for the remainder of the week. So she missed work due to this. (But, it gets better)</p>
<p>
Now -for the pièce de résistance:</p>
<p>Later that everning, the department chair <b>replied using the appeal email that my wife sent her</b>, with this explanation:</p>
<p><i>&#8220;Mrs. Xxxxxx, As I told you in the hall at the Xxxxxx Annex, there are policies in place which guide any decisions I make. I am unable to waive the Pinning and/or Graduation <b>policy for students who have not successfully passed the exit HESI. </b>Dr. Xxxxxxx&#8221;</i></p>
<p>Contained in that very same email are these first three sentences from my wife:</p>
<p><i>Dr. Xxxxxxx,<br />
I do appreciate the extra points. I ask that Test 1, Test 3 and the Final be examined as well. I am appealing my grade. Again, I state my reasoning &#8211; <u><b>having passed the HESI test</b></u> which is the major bench mark our school measures our future nurses and their success. </i><br />
This seems to highlight a few things:</p>
<p>- My wife was removed without merit<br />
- The department chair apparently didn&#8217;t give my wife&#8217;s appeal any merit at all<br />
- The department chair is not capable of checking her facts prior to issuing an email.</p>
<p>So- my question. Is there a legal case here? I know that at the very least this is a moral injustice, but would it be legally? If so, what is the best approach?</p>
<p>I don&#8217;t pretend to be a lawyer, and we have never sued anyone in our lives (we are in our late 40&#8242;s), but this seems very wrong.</p></div>

<div>Last year Chase Bank filed for a garnishment against me in to the 19th district court <br />
here in Michigan for a debt of $18,000. They won the garnishment and now The state of Michigan is writing for me to say that they are withholding the refund of $1510 because of the garnishment order. They are forwarding to me form 743 to fill up to determine how much they can release to my spouse since we filled a joint return. The question is can I file for bankruptcy right now to be able to redeem my refund back. If my wife has no debt with Chase bank can she still get her portion of the state refund. Thank you very much.</div>

<p>Here is my situation.</p>

<p>I have a decent paying job in a career that is fairly secure in employment.  For several years I was able to build a little savings and build my credit up pretty well.  We weren&#8217;t living lavishly but had some creit card debt that I was able to keep in front of and never got behind.  About 2 years ago, things started getting a little shaky.  My wife began having terrible health and the doctor bills and medication bills began to mount a little.  I was able to handle these bills, but needed to start using credit a little more for everyday items. mainly groceries and gasoline.  Birthday presents for kids, etc. I exhausted the bulk of savings before I did this.   I had two creit cards and wound up maxing them out while the medical bills continued to mount.  Then I had a medical issue that kept me out of work for awhile and required surgery.  Also, we have been having terrible luck with vehicles lately. So, I missed a couple paychecks, and at the same time, my wife lost her income,  and got into some really hotwater, financially.  We have managed to keep the house, utilities, food and gasoline going, but there just isn&#8217;t much left over to pay credit card debt. Therefore, payments get missed and I have to play catchup.</p>
<p> </p>
<p>I&#8217;m to the point that I am considering picking an account to pay off and throwing every available dollar at it until it is paid and then move on tot he next.  However, that would mean some accounts go unpaid for several months.  I just can&#8217;t bring myself to do that, but at the same time, paying minimum payments on several accounts and not really able to put any meaningful dents into anything jsut seems like I am spinning my wheels.  In the meantime, medical bills are outstanding and it all so overwhelming.  For someone that spent alot of time building up some credit and savings over several years and basically having the whole house of cards come crashing down in a few months (was able to keep it togeter for about 18 months and then it all came crashing down) this is very frustrating and feel like I will never work out of it.  Any strategy or advice from this forum would be appreciated.  I&#8217;ll take anything at this point.</p>

<p>So i went to work!  i opened up an Amex HYS account and moved 90% of our liquid funds  into it. i then setup all our automatic bill payments to draw from our USAA rewards cc, ditched the debit card, and use strictly credit ( plan PIF each month)</p>

<p>just started this but my plan is to use our cc&#8217;s for everything, and put our direct deposit&#8217;s into the HYS, and withdraw the cash needed to cover the monthly bills every month. Still a work in progress as we need to get a feel for how this will play out, but i think it&#8217;s a solid plan..</p>
<p> </p>
<p>anyone else have any similar or better strategies they use? </p>

Its still reporting with EX &#038; TU.</p>
<p>Its a very active account that my wife and I use.</p>

<p>Did EQ do this, if so why?</p>
<p> </p>
<p>Did cap one do it?</p>
<p> </p>
<p>Could I possibly have a split file?</p>
<p> </p>
<p>I&#8217;m not sure what to do. I know that if I call cap one, I&#8217;ll get a rep whose clueless about credit reporting. If I call  EQ they&#8217;ll tell me to contact the creditor.</p>

<div>My wife has failed to respond to the initial divorce petition and notice of default. A default hearing was scheduled for early next week but has been put aside and resheduled because she filed a motion to vacate the default judgement. The commissioner allowed it and now she will be attending and be heard at the new hearing. How can she have recourse at this point? Can I present evidence regarding her DUI and drug arrests prior to or at this hearing. I am seeking sole custody of my 2 teenage kids. They have lived with me since the wife left in 2009. Any thoughts would be appreciated.</div>

<div><b>I had recently bee jailed on a failure to appear from a D.U.I. in 2006. In the case I was ordered to complete 10/12 classes due to being evaluated a moderate risk. I had completed the classes but had lost my job before I could pay the final $400.00 to aquire the certificates that the court had wanted as proof. As a result,I signed a guilty plea without the knowledge that my wife had paid for and faxed the certificates to the LaSalle County&#8217;s States Attorney&#8217;s Office. I am currently within the 30 period where I am able to withdraw my plea of guilt. I have the proof that needs to be provided to the court,that the classes were finished in a timely fashion,I am at a loss however as to what motion that I need to file or where I might be able to get the forms. I have been looking every where for free downloadable motions to no avail. I do know that in order to file the motion that I must have sound ground on which to stand and must list every and all reason as to why I want the judgement vacated. My biggest sticking point are the forms that I must use to file it. Is one able to write up there own motion to vacate,set aside,or correct sentence? Please help as I need to get this paper work filed. Any help is appreciated.</b></div>
