I am not underwater, but I definately don&#8217;t have 20% equity so prior to now I haven&#8217;t been able to get a new loan, since I am still current on the one I have.  I know the rules aren&#8217;t published yet, but I want to be ready to go on March 5.  My taxes have gone up about $  700 per mo. since the original loan (I live in NJ) so I am above the 38% threshold.  I would love to get rid of my present mortgage holder, but can I, while taking advantage of the new bill?</p>

<p>My cpa filed our married filing jointly New York State tax return last Saturday afternoon using a software called Greattax Pro.  While she was filling out our taxes, she asked us if we would like to make a payment towards our tax liability. We agreed to make a partial payment of $800 towards our $2650 tax bill and gave her permission to make an ACH debit (online payment from my checking account).  Later on that evening, I receive a phone call from the cpa stating that NYS Dept of Tax and Finance does not accept partial ach debits so we would have to mail in a check for $800 instead.</p>
<p>Yesterday afternoon (Tuesday), I checked my bank account and I noticed that $2650 was deducted, resulting in a negative balance and several overdraft fees.  Of course, I contacted my cpa to find out what happened and she said that the tax prep software, Greattax Pro, allowed her to submit the $800 payment.  However, the software company stated that an error message would have popped up rejecting the $800 payment and suggesting that the user either pay the entire tax amount or remove the payment. The company also said that the cpa must have input the entire tax liability.  The software company is refusing to provide a letter stating that the cpa meant to input the $800 or provide screenshots and suggested that the cpa would need to contact the NYS Dept of Finance.  However, because we did not authorize her as a third-party representative NYS Dept of Finance will not discuss our return with her.</p>
<p>My husband and I did not see what the cpa entered into the software and we did sign an authorization form allowing her to deduct funds from our account.  However, our tax return says nothing about the $800 payment.  NYS Dept of Tax and Finance is refusing to refund the money because, as they see it, my husband and I do owe NYS those funds and our return says nothing about the $800 request.  The software company is refusing to take ownership because the error message warned the cpa to make an adjustment.  The cpa is refusing to replace the money because she said that not only does she not have the funds, but it is also our fault for signing the tax returns.</p>
<p>To our embarrassment, we neglected to look at the cpa&#8217;s computer screen as she was inputting our information. Our bank is willing to give us a temporary credit, but warns that if NYS Tax can prove that the bill is owed, the credit will be removed.</p>
<p>Suffice it to say, we will not use this cpa again in the future.  What should we do?</p></div>

<div>hey gang, was wondering if i have a case to sue my ex for paid child support. i found out about 2 years ago that both my children (ages 9 and 10) were not mine , biologically. since then i was forced, i use the term loosely, into signing over my parental rights. that was THE ONLY way to get out of paying any further child support. my intention was to carry on as father and vacate my child support. well that didn&#8217;t happen, the only way out of child support is to sign off as father. after this i was still responsible for the arrears owed. the mother and i agreed verbally that i would continue on as father and she would give me any/all money paid towards the arrears. so that went smoothly until september 2010 there was $1,200.00 taken from the child support credit card (eppicard). she went on welfare w/o telling me and welfare took that money off of the card. i let that go. now i filed my taxes for 2010 and it paid off my remaining arrears and went to the child support card. she went and had my card cancelled and had a new one sent to her home and spent the whole $3,500 that was on the card. my question is can i sue her civilly for past child support that i paid her, she has already admitted under oath that she knew there was a possibility that they weren&#8217;t mine? if i can sue her, can i file 2 seperate orders, one for each child? i also believe they are from different fathers. thank you for all responses!</div>

<p>Let&#8217;s say the convenience fee for charging your taxes is 2.3%. And let&#8217;s say you use a card with a 2% cashback or a card whose earned mileage points would be equivalent to 2% cashback.</p>
<p>If you pay say $4,000 in taxes, (2.3 &#8211; 2.0)% of $4,000 is $12. That&#8217;s ok for almost one month of credit (pay before statement cutoff) or almost two months (pay by due date).</p>
<p>If you don&#8217;t need the credit and put the $4,000 in your 401(k), it&#8217;ll earn about 8% / 12 of $4,000 is $26 in one month and $52 in two. That looks ok to me.</p>
<p>The above assumes of course you have the needed cash and pay the credit card bill on time.</p>

They didn&#8217;t really send me a formal letter as such, but rather an &#8220;3 options/plans&#8221; to settle form. Seeing as this occurred just within weeks of my checking my credit report (which showed no negative items and a score of roughly 725 or so), this is obviously junk debt that is past the SOL. I sent them a C&#038;D letter after that and heard/received nothing until a few weeks ago when I received the popular 1099c form. They are claiming THEY wrote off/canceled a debt of $1,223.10 on 12/24/10. They were never the original creditor of any of my financial accounts. I did have a card that was charged off years ago (2000 or 2001) and I&#8217;m assuming this is where they got it from. I was wondering if anyone has gone through the entire situation with this 1099c stuff and could perhaps advise me on what to do next? I want to file my taxes for this year but don&#8217;t know if I can until this is taken care of? Can I just go ahead with filing for this year? I was under the impression that only the original creditor could issue this form and it would have to be within the tax year that it was written off, not when JDB buys it from the OC and then re-writes it off. What is my next move here?   I&#8217;d really appreciate anyone&#8217;s insight into this situation. I feel badly about the debt, but do not want to pay some collection agency who bought it for pennies on the dollar. <div>I have been living in my home for over 15 yrs.  As everyone knows, times have been hard for the past 2 yrs.</p>
<p>There is a 1st mortgage on the property, and a 2nd, also a medical lien.<br />
Its been a Hard time keeping the payments on time, with 1 payment missing on the 1st mortgage and a few or more payments missing on the 2nd mortgage.  However the 2nd mortgage is only 14 k and the 1st is 44k the property is worth 150k Maybe ?</p>
<p>Now after tending to putting out the circle of fires that keep popping up around my life, this is now going on.</p>
<p>I live in a separate Tax district from the town, we pay a town tax which is in escrow. Then we have to pay an additional tax to our &#8220;Lake&#8221; district.  I know the taxes have been delinquent on the Lake tax and there was a lien on the property for that.  Now the Lake district wants to hold a Tax Sale?   I found out when it was published in the news paper through friends.  When I contacted the Lake tax collector she gave me a phone # to call with a name, and said he was very nice and would be willing to work out a payment plan, and the last thing he would want to do is sell my home.</p>
<p>When I called the phone# the person knew who i was without my telling him?  Then i explained the reason for my call and wanted to pay my tax or work out a payment plan.  The response i received was &#8220;Too Late&#8221;  &#8220;you can pay what you like&#8221; but if your payment isn&#8217;t in Full, your home will be sold in a Tax Sale&#8221;. !  <br />
I then called my 401k provider and had started on getting the 3600 needed to pay the back tax.  </p>
<p>2 weeks past and still have not had the check cleared from the 401k.  Now it gets better!   I phoned the 1st mortgage co. and they connect me to the Tax dept.  The man i spoke to said they have No Knowledge of Taxes being owed told me they would send me something in 7 days and gave me a Case #.  This was on 3/1/11, in today&#8217;s Mail is a Release saying the Taxes and all fee&#8217;s have been paid and the Tax sale is Canceled, and that was dated on 2/28/11.</p>
<p>Now after all that and i apologize for my length in the story.  My question is Who paid for my taxes after going threw all the agony and selling stock in 401k to keep my home, not too mention stress.  </p>
<p>It says on the release that the Core Logistic Tax Service Paid my taxes?  <br />
Well who are they?  My worry is that they are going to turn around and tell me i have to pay double of what i owed ?   The release says nothing of the 1st or 2nd lien holders ?   Is this what happens when you owe back taxes and don&#8217;t pay 1 month after the 1st publication in a news paper ?  </p>
<p>Feel like this has all been done under my nose, by an unethical, sneaky, scam artist lawyer !:mad:</p></div>

<p>Also, if someone is teaching privates and having checks written to them instead of the school they are renting from &#8211; 1) How does one claim this on their taxes. 2) Should the individual have a registered tax ID number as a small buisness, or does this fall under the larger buisness for which they work for? (the place where they are renting) At which point the checks should be written to the buisness instead?</p>

(Also, I only filed for half the amount paid for this year, if I file in district or federal court to receive it, can I change the amended return and claim all the taxes that were paid?) ]]></description>
