My lease was up 6/1/11.
I had asked my landlord at the end of February if there would be any penalties if I broke my lease. He told me there would be no penalties. I have a witness to this. So it was agreed that he would start looking for a new tenant but I made it clear that I would stay out for the month of March since it was right around the corner.
Come March 1st I paid my rent on time and he cashed the check immediately. Three days later, 3/3/11, I get a phone call at 2pm asking me if I could move out by Saturday 3/5/11 because he found a new tenant. The only reason I agreed to this quick move was because he told me he would reimburse me 3 weeks worth of March rent plus my security. I have a witness to this as well.
So come that Saturday I was rushed out and complied to all requests made by the landlord. He gave me a check for my security and told me in front of my friends that he would mail me the check for the March rent after his new tenant’s check cleared.
Two weeks later he is ignoring my phone calls but I finally get a hold of him and he only wants to give me $400. My rent was $1150. He says I broke the lease and made him rush to find a new tenant. Why would I have paid for the entire month of March and leave 5 days later without any incentive?? I could have refused to move and stay until 3/31/11?
I know it is my fault that I have nothing in writing but I have two witnesses and the cancelled check he immediately cashed. Can I sue him?

I share custody of my son with my ex. He gets him three weekends out of every month. The 2nd, 3rd and 4th. I have him on the 1st weekend. The judge said that our weekends start Friday at 6:00 p.m. and end Sunday at 9:00 p.m.. This month I planned a trip to the snow on my only weekend with my son. Since the 1st is on a Saturday this month, I thought that my weekend was next week, when I could finally get a full weekend with him. Is this the case or is this weekend mine even though the first of January is a Saturday?

Hi, I wasn't sure where to put this question, so I figured I would put it here. Basically here is what is going on, I am picking up a new car next Saturday, I am putting $4,000 down on the car. The money for the down payment I am getting from a settlement for a car accident 6 months ago. The check is for $10,500 and will be getting here tomorrow. Now my problem is, how can I get this money cleared and in my account by Saturday? It is an out-of-state check, and I was told that if I take it to the bank, ask for a manager, explain the situation, than they will usually grant me the $4,000 I need and hold the rest until the check is cleared, as long as they can call the person on the check and get confirmation that it is legitimate. Is this true? Do you know of any other ways of getting this money cleared? I already paid the dealer $500 to hold the car until this upcoming weekend, and I am not sure they will be willing to hold it for another week. Thank you so much!

I was fired from my job on a Wednesday around 10:20 am, and was told to come and get my check on Friday. I show up Friday at around 10 ’til 3 about 52 hours later, but there are no paychecks yet, so I was told to come back on Monday, I say I’ll come back on Saturday (72 hours), but I was told the checks might be locked up. I go home and hear nothing from them. So I come back on Saturday in the morning, a little over the 72 hours later, as I will forgive them and hour. So I get there, and there is no one in the front office, I go around the back and have an employee get a supervisor who makes a few phone calls, long story short, no paycheck, it’s locked up, come back on Monday.

I’m thinking, I might be entitled to pay + 3 times damages. Your thoughts ? Also, am I entitled to my Payed Time Off?

Hello,

I am a registered dental hygienist in the state of michigan and have worked for a particular company since june. I started off assisting then they had me working as a dental hygienist in several offices. The main office that I work in is very hectic and stressful. They let one of the dental hygienists go last august, and proceeded to let another go the following november that was full time.

Two weeks ago I was offered a position there for 2 days a week and every other saturday by the office manager. I told her I would gladly accept. One week goes by and the following monday she calls me into the Dr’s office and says “I’m so sorry I messed up. Unfortunately I cannot give you this position because of legal issues. We have to bring ****** back because technically we laid her off and we had to offer her her job back.”

So, the hygienist is being offered her job back, but not quite. She still lost her benefits because she is part time. And I was offered a job and had it taken away. This was the same company that had me working full time and had me in the system as a “temp” for 5 months and refused to offer me insurance though it was offered to everyone else.

Any input would be greatly appreciated.

I have two children, 9 years and 6 years. I am the non-custodial parent due to a custody order that was put into place in 2004 because the judge did not have a choice because I was not in court. The visitation was I had them every other week from Friday to Tuesday and their dad had them every other week from Wednesday to Friday. Their father had another child with his wife and she then filed for divorce. My children’s father sent my children to live with me in April of 2009 when his wife left and he has had very little to do with them and has not offered nor given me any support for them. He has his son who he had with his ex wife every other weekend and sees his daughters one saturday a month. Since his wife left, he has been admitted to the mental institution, has had a DUI, and now has three warrants out for his arrest for assault. Granted his mom gets them one weekend a month and that is the Saturday he sees them and his grandmother has kept them after school. I recently got married and my husband has been constant in my children’s lives for 6 years and has been their main financial provider. He has been offered a job in another state and offered a signifigant pay raise including health benefits for my children and I. This will allow me the chance to complete vet school and I think it will be very beneficial to my children. Of course I would be willing to give their father visitation. Either all summer each summer and every spring break and every other major holiday and I would be willing to pay for transportation expenses. What do you think my chances of a judge granting me permission to move and full custody are?
