I’m writing a novel that’s loosely based on my experience with being mobbed – that is cyberstalked by a group of people on a website. I’d like the ending to beat the reality though. So, I need information from lawyers. The case scenario: Woman from New York and her friends from all across the country cyberstalks a Pennsylvanian woman. BUT, the New Yorker lives with her sister, who ends up seeing what’s happening, and decides to help the Pennsylvanian being stalked. (She can gather all the proof needed from her sister’s computer.) So the cyberstalker’s target has the proof.

What proof would warrant legal action? (And dream big – picture best case scenario, That’s the beauty of fiction. lol) What can happen legally? Can police get involved? Can the New Yorker be arrested? Can those, who helped her, be arrested? What are the real laws concerning cyberstalking in America? From everything I’ve found online, the best case scenario is a court case, and nothing happens anyway. This seems like such a vague thing in America right now. I need to find out what really happens. Every site I’ve found on the subject says to report it to the police and hire a lawyer, if you have the evidence, but they all stop there, as if there is a huge void in the law, which really signals, “It’s legal.” Or, at least, “It’s not illegal.”

Thanks.

Lynn

Hello, i could use some quick advice because this home living situation here is becoming unbearable, im at the point where i dont want to live here or live at all and becoming sort of desperate to find relief. I live in Los Angeles with my father, and my dad got married almost 2 years ago
i met my step mother almost a year ago in iran, and since ive been living around her, i have not seen one period of time where she does not throw fits. She could be fine for several days, but after a while she just makes an excuse for an argument. my dad has filed for divorce against her back in Iran, because thats where they are married. He got sick of her so he did it, and came back to California alone, after me. My step mom remained in iran as my dad told her to stay so he could stabilize my situation like working and going to school. She stayed there for some weeks, and went to germany because she lived there before and is a citizen there.

Not long after, she was getting on a plane from germany and told my dad that same day when she was at the airport coming to California. 12 hours later, she lands in LA and has been staying with us since. I really dont mind my dad getting remarried, my bio-mother did it so i got used to a step parent, but this lady is insane. You would think in the majority of these middle eastern couples that the man has the advantage and the woman is being bullied around but in fact the opposite is true. She bullies him, yells at him, throws things at him, has locked him in the bedroom before, demands things of him, makes him go get her money from an ATM when shes feeling the pinch, and above all asks him to do things for her like get her a credit card, get her an American greencard and for what? so she can be stronger and a recognized person in the US so she can mess with us even worse?

My dad says shes only come to America with us to get a greencard, get a lawyer and divorce my dad to take him for what hes got to lose. i have thought he was just being paranoid but i notice she questions wheres his been, acts suspicious about my dads whereabouts and actions CONSTANTLY, and won’t seem to let us have peace for more then a couple days or so. She’ll throw an argument over anything, seriously. My dad even says from all the relationships he’s ever been in, he’s never been with anyone this angry or verbally abusive.

Our biggest problem: she lives with us in this house. shes been here over about a month now, and my father and i want out. I’ve told my dad several times, we should wait for her to throw a fit and call the authorities if she were to go out of control, but he always says no no, she’ll bruise herself and tell the police he hit her, and they will take my dad to jail. I try to assure my dad he has more rights then the responsibility of taking care of your spouse, which has been used only for purposes to support her nefarious schemes.
My dad is trying to rent our house out so if she even brings up that shes his wife and he has to take of her therefore enforcing her right to remain at his residence, so wont be obligated to let her stay or continue to live with her . Do we really have to go through the trouble of renting our house, me going to live at some strangers house as a room mate and my dad going to stay in a hotel – just to get rid of this monster?
please tell me what to do, i have never experienced this much grief ever or seen my dad bear that much of it.

I was at a party last night and received an MIP of "Minor in possess of alcoholic beverage, 1/7 full small water bottle".

I was at a party last night and received an MIP of “Minor in possess of alcoholic beverage, 1/7 full small water bottle”.
I did indeed have the bottle in my hand, and it was indeed 1/7th ish full of an alcoholic beverage. The misdemeanor was circled.

This is my first offense of any kind, and I am a 16 year old upcoming senior at high school with a 3.8 GPA, 2290 SAT, and 6 5′s on Ap tests.

I’m wondering:
1) If there is any way to have the misdemeanor NOT go on my permanent record. I turn 18 while in college, so I need to not have it on my record by the time I apply to college, which is very very soon.
2) Having the misdemeanor changed to an infraction? How would I go about this?
3) Going through a diversion program (County: Orange County, in So Cal) that may be offered? How can I approach this?
4) Is there any way to save my driver’s license? I realize that under the code 25662 (A) B&P if convicted of this misdemeanor, I SHALL have my license taken away for a year.
5) Pleading…since its a juvenile situation, is there the whole pleading deal? If so, what should I plead? I admitted to the police officer I had a few sips of the beverage and that it was not mine, but since I was not under an oath, this should not hold, am I correct? Will the police officer be present? What would pleading not guilty mean I am doing?

New York , I’m an adult and should know better, but I messed up big time.

New York , I’m an adult and should know better, but I messed up big time. I’ve been shoplifting at a local retail store on a regular basis, last week I was caught. First offense. I am sick to my stomach from the moment I wake until I fall asleep. Yes, most probably because I was caught, however, I am greatly remorseful and I know I will never ever do this again; not ever. All the guilt I feel and humiliation of people finding out about this is not worth it. I did not admit any wrong doing, all items were in the open sitting in the shopping cart, the total was $151. I was asked if I had money to pay for it and I nodded that I did. There was nothing hidden on my person. They did photograph me holding a paper they had me sign stating that I could not trespass for two years. The police were called, I was taken in hand cuffs to the police station, I was not questioned, nor did I volunteer any information; I was photographed again and fingerprinted. I have a court appearance in two weeks. I hired an attorney. I was told that I would be pleading ‘not guilty’. This was the biggest mistake of my life and really don’t have a good excuse as to why I continued to take what was not mine, except to say the more that I got away with it the more I kept it up. The store wanted me to sign a paper that had to do with Civil Restitution; he said I had ten days to pay them $500, but I declined to sign it. I thought that since I did not sign that paper, that they would mail it to me, but it has been one week and I have not received anything in the mail from them. My attorney told me to ignore anything I get in the mail from them. I keep thinking that if they were to go back and watch surveillance video’s for the previous few weeks that they will see me not going through a checkout and figure out that I have done this before and got away with it. Is there even a remote possibility that this could happen? Would this be considered evidence/proof that I had done it before? If the video shows me leaving the store without going thru a checkout can they charge me for those times also? How long do stores usually keep these video’s? My mind is playing tricks on me and I can’t eat or sleep. I am wondering why I have not received that Civil Restitution for the $500; could it be because there could be additional charges in the works? What is your best guess as to the penalties i am facing.

Me and my friend went to buy beer from a local beer supplier the other day. Usually the owner does not ID us and just lets us go but this time there may have been an undercover police officer in the store. When we went to the register to buy the beer i was given no other option but to show my real ,underage, ID. The owner denied us and we left the store. My question is, is it possible for me to get a summons or something from the police officer even though he never spoke to us or questioned us. I know i am probably just paranoid but could to owner of the store give my information away to the officer and then i receive a summons later for trying to purchase beer underage.

My stepson (14yrs of age)was apparently involved in an altercation at a local carnival. He ran from the officer that attempted to stop him and when he ran the officer tackled him to the ground. Apparently the officer injured his hand and received medical treatment including therapy. Now, the bill in excess of $11k. We are the legal custodian (primary physical custody) of the child. We live in VA. Although he was visiting his father in PA, when this occurred and his father took him to the carnival, we were in VA. Is my wife, the legal custodian, of the child responsible for the claim the insurance company is making since he was visiting his father in another state? We have received no police report, no documentation as to the injury or incident. The boys father denies it is his responsibility since we are the legal custodians. Funny thing is his father knows this police officer. And he told them to send us the bills. Thanks for any advice you can give.

My nephew plans to move out when he turns 18 years old. Unfortunately, we anticipate a major scene from his dad and stepmother. They lack self control and I anticipate they will prevent him from taking any of his stuff–clothes, electronics, etc ( or destroy the stuff). I’ve considered having the police there when he tries to pack up his stuff. Does he have a legal right to take his personal property? He is planning on going to college and will need his dad’s medical coverage and information for FAFSA. Anything he can do to make sure he has access to that information if his dad does not cooperate?

Auntie trying to help

I live in Santa Monica, CA.
a rent controlled apartment.

So I had 3 roommates. A and B we’ll call them.
A and I are on the lease, but B is not, but he had permission from the landlord to be here.

A and I paid for deposit, I paid for a little bit more since I had dogs. The lease we signed ended, and is on month to month now.
A and B both moved out, and I told them to make sure to do a move out clean of the apartment and we could all pay for the cleaning fee together. Which wouldn’t have been much anyway.
But they didn’t. And still owned me 2 month worth of utilities. And the landlord stopped by the other day and got really angry at how the apartment was left. So I cleaned the apartment, since I would still be living here. But the landlord did say he would have to repaint the walls.
B managed to give me his share of the utilities. and we have no problem whatsoever. A however, demanded that I give him his full deposit back ($800), and said that this is the way his friends do it, that whoever is left in the apartment is responsible to give the people who moved out their deposits back.
Now I’ve never heard of this, and I have been living in Cali for quite a while. To my understand, its the landlord who gives back the deposits within 30 days (its only been 2 weeks since he moved out), and since our original lease was up anyway it doesn’t make me responsible as the last person left on the lease who still lives here. I’ve explained this to A, and told him that it was his responsibility to make sure he gets his portion of the deposit back by cleaning, and doing a walk through and communicating with the landlord. Now he refuses to pay me the 2 months utilities ($172) and is coming to my house to try to get his deposit from me. I’ve been really busy lately, and haven’t been home during the day, but my neighbors have told me that he’s been banging on the doors and windows and trying to open the locks. Technically, it is now my apartment and he should not be coming without permission right?

Will my landlord be able to do anything to stop him from harassing me for deposits? My landlord told me that he would be giving A deposit after he decide on the repainting charges (only for A’s room, and part of the living room). But A says none of the damages are his fault and shouldn’t be paid out of his deposit.

Do I really have to resort to calling the police if he tries to force his way into the apartment? I don’t want to make this into a huge deal, and make it seem like I’m a trouble maker especially because I have a good relationship with the landlord and the neighbors.

Thanks!

I live in Texas, my wife and our son live in Georgia. We are not divorced yet. She lives in very filthy conditions, I have photo evidence and witnesses. Her neighbors have contacted me and explained all of her bizarre behavior to me. She has left my son with her parents. I want to go get him. I have tried to convince her to let me just come get him, because it is obvious that she does not want him, but every time I mention it she acts like she cares about his well being. She has put him in physical danger, and I need to get him out of the situation. Her parents will throw a fit and call the police if I just show up to take him. I need to know the best plan of action to get him here with me ASAP. He is in danger as long as his mother is around him. As his father I believe it is my sole right to have custody of him due to her behavior. NOT HER PARENTS!
