I joined a start up in a small highly technical industry. I was with the company for a very short time. I found a number of questionable things at the company and resigned a few months after joining. Almost within an hour I started receiving threatening emails from the owner. I notified the police about the threats and was told they would not get involved.

I had started to look for a new position within the industry and after speaking with another company was informed that the owner of the startup was calling around and telling competitors that I would be looking for a job. They should know that I was a convicted sex offender and was fired for it. Apparently this has been said to a number of people at different companies.

I am not a sex offender and I have never been accused or convicted of any sort of criminal activity.

The problem I face is I cannot afford an attorney. I’ve spoken with many attorneys and no one will touch this case on contingent. This has been extremely devastating to me both financially and emotionally. I can’t get a restraining order as no specific threat of physical violence was made. I am now filing for bankruptcy and about to be evicted from my home because I can’t find work.

Can anyone suggest something I can do?

I’m having problem with a neighbor and need some advice. We live on a street of fully attached houses where the garage for each house in the rear and accessed via a common driveway. There is an easement that requires the each homeowner to allow the others access to their portion of the driveway. The driveway is 20 feet wide, so there is enough space for a car to be parked in front of each gagage and others to pass.

The problem I’m having is a neighbor who keeps parking his car in front of my garage. I’ve told him several times to stop this practice, but it seems that whenever he can not find a parking space on the street, he parks in the rear in front of my garage. (he has converted his garage into living space and his son parks in front of his property).

This is private property, so the Police will not issue a summons. What options do I have?

On Friday April 29th, 2011 my neighbors in the apartment behind me got into a fight. The police were called. I was a witness so as I was waiting to talk to the police, my boyfriend didn’t want me talking to them so he got mad at me. After I was done talking to the police I went inside my apartment and my boyfriend got snappy with me. I threw a shoe at him. He came at me and tried to hit me. I pushed him and said go ahead hit me. He then put his hands around my throat. When he let go, I bit him and ran outside. The police were still outside dealing with the neighbors when they came up to me and asked what was going on. I told them. They asked me what I wanted to do. I said to let it go. Then they saw I left a mark on my boyfriend from where I bit him and they arrested us both. I had no shoes on, they didn’t even let me get my shoes. Then they went into my house. My boyfriends ID was in a cabinet. When they went into the cabinet to get his ID they found our bong. Which we do not smoke out of. We just sort of have it because it cost a lot of money and we didn’t want to throw it away. We kept it as sort of a memorabilia. When we went to jail, they tested the bong and found residue in it even though we haven’t smoked out of it in a long time.
The next day, the judge didn’t want to do his job so he left his court and said he wouldn’t be back until 5pm. The police called the PA District Attorney and had us released and spend the weekend apart with no contact. We have no formal paperwork as of yet. We were charged with simple assault (which we are not pressing charges against each other and the police never took statements from us while we were in jail they just left us there for 14 hours) drug paraphernalia with the intent to smoke marijuana, (which there are no drugs in our system so they can’t prove we smoked out of it) and I believe, not entirely sure, disorderly conduct (which I don’t know where that came from because the fight was in our apartment, we didn’t resist arrest or fight the cops). I’m not sure what to look for here and I can’t afford a lawyer. I plan on calling a legal aid on Monday to get advice. I’d like some advice on what to do here.

My husband was arrested back in Nov. 2010 .He was hunting on public land and was up in a tree stand when 3 men approached him cussing him because he was in their stand . He told them ok and he’d get down . Well he lowered his gun down which was a Black powder gun ..As he was getting down they took off and called game warden an the police. Husband went to the truck where police and game warden was waiting and arrested him. My husband is a convicted felon but that has been 13 yrs ago and has not been in any trouble what so ever . The police officer said they arrested him for having a gun . they take him to jail this is 9:00 am and he sits there all day tring to figure out what they were gonna charge him The sheiff came in and shook his hand and told him he was going home , that they had nothing on him.

Well finally they decided to charge him with pointing a gun. Nothing was said about pointing a gun when I went to pick up our truck. The three guys said he pointed a gun at them. Now these guys went into the woods , not wearing hunting close. These guys are well known as bullys. My husbands would never point a gun at anyone. He is probably the most careful hunter out there , anyone that knows him will tell you.

We live the simple life , he hunts and fishes, dont go to the bars or cause trouble. these three guys are always doing something , in fact one of them got aqrrested in Dec 2010 for hunting on private property without permission, spotlighting and shooting from his truck and has many other on his record. Anyway I will get to the point. We try to live our life right , my husband is a good man and one stupid mistake 13yrs ago has turned our wourld upside down. having a gun after a felony …..thought you could have a black powder. He didnt even have to bail out the Judge O R him out. He went to court yesterday and the Assitance DA made a plea offer Count 1 FP After Felony 5 yrs in DOC other: ……we amed to ???? Poss of a firearm after Felony count 2nd page, would carry R O P 4 to life. I dont understand ???? OH we do have a lawyer , paid him 2500.00 and we had to tell him about one of the guys getting in trouble. My husband is not gonna plead guilty for something he didnt do but yet we dont have 25000.00 to take it to jury trial. like I said this has turned our world all upside down , We spend every waking minute with our grandkids.. Is there anything we can do or is it a lost cause… We live in Wagoner , Wagoner county Our lawyer is the ex DA … but he was under the guns before he left….there is so much about this story , its all a money thing …..thankyou for taking the time to read this

I live in Detroit, MI in an apartment building owned by a certain company. Recently I was assaulted by employees of this company, namely the manager of the building, and two maintenance men. About a week ago I heard a commotion in the hallway after my friend had just left my apartment. After taking two steps into the hallway, the manager (a woman named M*******) turned on me from the other end of the hallway. She started screaming at me “GET OUT OF MY BUILDING!” and stomped towards me. When she reached me she pushed me. I said “Keep your f*cking hands of me!” and pushed her off. At which point she started swinging on me. I didn’t return any blows, only dodged hers. Before I knew it, a maintenance man is squaring up with me and started swinging. Defending myself I began to throw punches of my own. When it looked like I might win the fight with the first man, a second man (also an employee) started punching me in the back of the head. I fought for as long as I could but eventually was overwhelmed and knocked out. When I could get up I got back into my apartment and locked the door, with them still pounding on it.

Seeing as this all happened for no apparent reason, I called the police. They never sent any officers or anything. I called again hours later and was told it “wasn’t an emergency, so if no ambulance is required then no officers will be dispatched, you should file a report with our assault line” I inquired as to how she knew it wasn’t an emergency she said “Well, your talking to me, do you want me to transfer you?” I was transferred and filed my report. Later I notice flashes of light in one eye that took the most punishment, and pain behind it. Looking online I learned that these symptoms are consistent with some kind of retinal detachment, which is a medical emergency, and I could go blind in that eye in a matter of days.

Now I’m wary to go to the ER as I have no health insurance and can’t afford any surgery they might wish to perform. I’m wondering if the company which employs these individuals (convicts, history of violent crime, mentally unstable, history of substance abuse, some on parole or probation, all of which they were aware of when hiring them) and owns the property on which the incident took place faces any liability. Any advice would be paramount.

I live in low income apartment building in Tennessee. Several weeks ago another man who lives on the same floor of the same building as I do pulled a knife on me following a debate. While he was waving the knife around I actually stood there long enough to ask what in retrospect now seems to be an incredibly stupid question, “Are you threatening with me that?” To which he replied oddly enough, “Yes, I am.”. I said, “that’s a mistake” and turned and walked directly to the office. As I retreated I watched him over my shoulder long enough to see him fold the knife and exit the front door of our building near where we had been standing. The building manager claims she believes me and even has reason to think he passed the knife to another individual before she approached him. However, both the manager and the police say it boils down to his word or mine and there’s nothing either can do. I filed a police report and took it to a judge who issued a summons accompanied with an order of no contact for the man who wielded the knife. He has been served with the summons and order of no contact and even took it to the office and showed the manager. There is a seating area out front (adjacent to the front door), of the apartment building where he continues to sit out front monitoring my coming and goings and hawk-eying me. He also sits out there and bad mouths me to my neighbors, claiming (among other things) I’m crazy and falsely accusing him. Yesterday, I went to walk my dog and while I was walking my dog he got up from the table to talk to friends. They stood and talked and blocked the front of the walkway where I had to walk around them to get back in the building. What if he gets on the elevator while I’m on elevator? Here’s the definition of the order I have found on the net:

THE NO CONTACT ORDER OF PROTECTION
The no contact order of protection prohibits the seven forms of abuse above, and also prohibits the defendant from coming about the plaintiff (coming within eye-shot of the plaintiff, where ever she/he may be). That means at home, at work, on the public streets, or anywhere else. It prohibits driving by the plaintiff’s home, her/his job site, or any place where she/he is.
The judge further stipulated this:

“THE CHINESE WALL” ORDER OF PROTECTION
This order of protection is the same as the no contact order of protection, but additionally prohibits all forms of communication from the defendant to the plaintiff. No telephone calls, mail, fax, pager messages, e-mail, or messages sent through third persons. Of course, messages via attorney-to-attorney contact are acceptable.

Admittedly, I’m confused , the no contact order seems very unclear or skewed when living in the same building as the offender. Can anyone please tell me what my rights are? Is he allowed to come physically close to me? How does the order work while he lives in the same building as I do? Thank you in advance for your help.

Leaving a bar at 1:45am Highway patrol driving in city limits flashed their lights and yelled for me to get out of my vehicle and walk towards them. I asked why they stopped me and they said I had not made a full stop at stop sign. I KNOW I made a full stop. A routine stop would require them to approach my vehicle and ask for DL, registration and insurance. They did not. They gave me a breathalizer and I blew .09. They handcuffed me and drove around over 2 hours making other arrests before taking me to jail. I was not given my miranda rights until I walked into the police station. Is all this legal for them to do?

I have a couple questions but this is the base:
“A Child in Need of Services” is considered a person under 18, truant, is a habitual runaway, in doing so presents a clear and substantial danger to the child’s life or health, the child or family is in need of treatment or rehabilitation services not being recieved, and the intervention of court is necessary to provide that treatment or rehabilitation.
My friend is seventeen, she was pulled out of high school by her parents and forced to be homeschooled, and then clep out of a few classes and then take numerous college classes. she is now a few credits away from earning her associates degree. she has maintained numerous jobs and has signed a contract with her parents for a summer camp counceling job out of state. she is in no need of any services. she already pays her own bills. her parents force her to pay rent.
in order to be emancipated she must either be married, in the military, living on her own, or her parents must give her consent.
she is currently under house arrest according to her parents. they have taken the license plates off of her car, taken her cell phoe, taken away her opportunities for further schooling and a summer job. they are going to take her off of the car and health insurance.
though she is capable of living on her own, she cannot unless she runs away.
virginia laws would not require the police to track her down and bring her home, but she could face a court order to explain why she ran away.
if she is not in need of services, can she walk up to a judge in a courthouse and explain her situation and reason for leaving? if so, why are emancipation laws so difficult?

My husband recently got arrested for Man/Del of a controlled substance over 4grams under 200grams. When he was arrested, he was immediately removed from the car and placed in the backseat of the police car while the officers searched the car. While in the backseat, the officers found a bag drugs in the driver’s seat floorboard. (Here is where everything gets messy.) This car that my husband was driving has no ties to us, meaning no insurance, no inspection, no registration, but seeing as how he was driving it he went to jail anyway. While in jail, he was approached by a narcotics agent who offered him a deal: He would lower his bond to next to nothing if my husband would give someone up after he got bonded out. My husband took the deal. The agent said he would also keep my husband from seeing prison, etc. etc. as long as he held up his end of the deal. A week later I bailed my husband out. That day, my husband, myself, and my two small children were kicked out of our house. So we moved into a motel.
Six weeks later, my family and I are on our way to an appointment when we realize that we are getting pulled over. My husband had failed to call this agent back so he had set us up to be pulled over and searched. The officers immediately put my husband in the backseat of the police car and began asking me and him where the drugs were. The agent searched the car…nothing. The agent pulled me aside before I drove off and offered me a deal, “let me search your motel room, and I won’t call cps on you.” I told him no.
Since that day, my children have been taken from me and placed in foster care, and my husband still sits in jail. He was taken to jail for traffic tickets that day and then his bond was surrendered about a week later due to him not updating his address when we moved into a motel. His bond company told me that they were tipped off we were going to jump town. (Not likely with two kids and my husband working full time.)
I’m currently in the process of trying to get my children back, and trying to help my husband in anyway I can. Please, any advice anyone can give is helpful. I just want my family back.

I wrote a check over four years ago to WalMart and it didn’t clear the bank. I paid the check and have the recipt showing payment. Through a recent background check I discovered that there is a warrant out on this matter. I contacted the Prosecuting Attorney’s office to ask and all they would tell me was to go turn myself in. Is there anyway I can avoid having to go to the police? Not sure what to do.
