unjust eviction

In Sept. we paid our rent and later that day the landlord came over and told us we had to move, his son needed the house to live in. It became a fiasco eventually, we had to have the police there on two occasions as he was interfering with our moving. Keep in mind we started moving with 2 weeks of his request to move. We sued him for moving costs and loss of business, as we have a home based business. He counter sued, then a few weeks later he requested a juried trial. Now we have to go through that. Need all the advice anyone can give me on picking jury and proper court procedures.

Stop Sign Illinois

Just got a ticket for not stopping at a stop sign completely. I believe that I did and the weird thing is the police officer says you can pay your 55$ at the courthouse or through mail. But I just checked the ticket and I can’t seem to find 55$ anywhere except for seat belt violation.

Wondering if I should fight it in Illinois. have not had a moving violation in 6 years (teenager times) The fact that i thought i did stop and he told me incorrect information regarding ticket payment price/info leads me to want to fight it. Will it have a large change in my insurance if at all? is taking traffic school worth it?

Anything i can object to for being told the wrong information?

Archery in the suburbs

This is a new type of neighbor harrasment. I bought my house 6 years ago and specifically bought it because of the 22 acre wood lot behind my property. I shoot competitive archery and it was the perfect house to practice my trade. Shortly after moving in, my neighbor had done some pretty amazing things. It all started when my friends from Ohio and driven down for a weeks vacation to go fishing. Not being able to distinguish where my property line was, they parked their boat and truck on the road but a little near his property. My neighbor than went and turned on his sprinkler system essentially filling my friends boat up with water. Myself and my friends confronted him and it got ugly. Fast forward 1 year later and my family is out back shooting archery like we have always done and he calls the police. They show up and after talking with me, inform the neighbor that I am doing nothing wrong. Two days later he threatens my son by getting his bow(didn’t know he had one) and shooting an arrow over his head into the woods and threatening to not miss him the next time. I immediately call the police who tell me that without the arrow they cannot do anything. He also has brandished a very large pistol in a threatening way while my kids are outside. Once again, cops say they can do nothing about it. So 3 days ago the chief of police stops by to inform me that my neighbor has contacted everyone in city government to complain about my archery shooting. Although there is no law against it, I could be charged with reckless handling of a weapon. I am a Pro archer and believe me…not reckless, but that is also a very broad word when used in the proper context. I got the feeling that the chief just wanted me to stop to remedy the situation. I want to file suit for harrasment charges or something, but not sure if I have a case. Any advice?

Underage drinking

I had to go pick my daughter up last night from a local police dept in Ohio. She had consumed a beer at a party, in which the police were called for underage drinking, and needless to say…my daughter is getting a citation sent in the mail. She is 15 years old. I’m just curious as to what the possible fines or punishment could be, and if she should ask for a deferred penalty or not? She wasn’t drunk, and she wasn’t put in jail, and seemed to be very cooperative with the police as well.. Any information given would be helpful.

Noise Pollution

We have been dealing with noisy neighbors since 2004. They have a commercial backhoe in which they use like is a wheel barrow. We tried speaking with the neighbor to no avail. We spoke to our towns building inspector who is friends with our neighbor and nothing was done. We have even gone to the board of health and have called the police several times and they basically came and said there is no noise ordinance in our town and that they can ask them to stop but they can run it til 10pm 7 days a week if they choose. Its been so bad at times that my infant son has not been able to sleep in his room because of the constant noise. My questions are 1st is it considered harassment if you ask someone to stop doing something that is bothering you and they continue? 2nd Is there any other way to deal with this without filing suit in court? 3rd is it worth filing suit and spending money? My families anxiety level is terrible! My four year old son is even yelling at them! We can’t have parties in the summers because they are out there almost every weekend. Now its spilt over to the winter months too. In addition to the backhoe problem there are other instances of their inconsiderate noise like this past weekend they let an lawn tractor idle for 2 hours and ran chainsaws on and off for about 6 hours for Sat and Sunday….

brain injury to our child

My question involves an injury that occurred in the state of: Idaho

My ex wife and I have a four year old son. A woman ran a stopsign and tboned my son and I. He was properly strapped into his car seat. She admitted she was at fault. My son has has been in intensive care at the big city hospital for 11 days now. My ex wife and I have both taken off work since the accident to be with him. Our son hasn’t woken up since then. the doctors didn’t expect him to make it, but he’s still hanging in there. Oh, I was delivering the car that was hit to a new owner. The new owner had the title, etc., already, and they have a policy that said it would help pay. The woman had ins too. I don’t know how much either policy is for. My ex has health insurance on our boy. So far it’s cost about 90k just in meds. He’s probably going to have brain damage, but they don’t know to what extent. I had a bruised kidney, and a lot of pain, but hopefully nothing permanent. Here are my questions:

1. I hired a lawyer, and he contacted both insurance carriers, the police dept., and the officer. He told us he needs to get a copy of the policies to see what the limits are. Am I stuck with the limits? I don’t think it’ll be enough to cover his meds right now, much less in the future if he’s disabled.

2. Is the lady’s insurance going to pay for all this? what about my own insurance policy, or the one that was on the car when it was wrecked? Can we ask them to help pay? And where does their obligation to help end, and my wife’s health insurance policy kick in?

3. My ex and I live over 200 miles away from the hospital. Will the insurance company pay our bills, lost wages, etc. while we are down here?

4. If the lady’s liability is obvious, and the insurance company or companies decide to just offer us the policy limits, what is my lawyer really doing for us? That doesn’t seem like it’s worth 30%.

5. What information should I be gathering right now? And is my just calling the three insurance companies enough to put them on notice of an accident?

defendant sent threat…Can I report to police?

Im taking a former friend to small claims court. Another mutual friend deleted the defendant from his facebook friends list and he contacted this mutual telling him “you deleted me because john is talking crap about me” etc etc etc…He went on to say “when I see him, im going knock his teeth out”

He’s just upset hes getting sued and is talking smack…..BUT

Is this something I should report to the police or do I have to wait for him to actually assault me?

If he does, what kind of charges can be brought against him?

Leave the scene, did not see the damage

I heard some noise while I was trying to park two spots in front of another car along the road. I thougt that because I driving on the snow (there was big snow on the road at that time), I also suspected that I might have contacted with the other car. I got off the car and checked my car, no obvious scractch. I also did not see obvious damage in the other car. I locked the car and went to work. Then two hours later, a got a message from my collegue that a police man has been looking for me. Actually I was not around in the office or the lab because I went to the bank after meeting with my boss. Then I called the police department and the police man came back. He seemed very angry, might because he had been looking for me for long time. He showed me the scratch on my car and the other car and gave me a ticket for “leave the scene”. I was pregnant at that time and was 12 days to my due date. I did not see the scratch might because it was hard for me to bend over and look for the scratches. I will go to a court trial in April. Not sure what should I do. I am from a foreign country and not familiar with the procedures/rules in the court in US. Any suggestions are appreciated!

Can the police seize my journal?

I live in Minnesota. In 1985 I suffered a brain injury (T.B.I.), and since that time I have not been able to retain memory for very long. I keep a journal for my important memories.
What I need to know is – Can the police seize my journal. I ask this because I witnessed the death of a young woman. I wrote in my journal what I saw and about the person who caused her death. I want to be able to talk to the police like everyone else using my journal as an extension of my memory. There are so many other memories in my journal the police have no right to see. I feel if the police take my journal it would be like going into my brain and stealing. As a witness I am no good without my journal. Also are there any court rulings on this subject?

Minor in Consumption age question

Hello, I am 18 and living in the state of Texas. A week ago i received a MIC in my city. Although i am 18 the police forced me to contact my parents for some reason. Later this week my parents received a letter stating that i am a minor child and that my parents must appear in court with me. From what i understand because i am 18 the city has no right to contact my parents at all, Is this true? and any legal advice on what i can do if they are trying to try me as a minor?

if it would help i can post a picture of the letter stating what it says to clear up some questions.
