<div>I was recently notified, by a individual third party, that a check I had written on Feb 25, 2011 had not cleared my bank when presented for payment on March 21, 2011.  The check was written to the local high school&#8217;s booster club.  The Treasurer of the booster club called another individual, not associated with the booster club, and informed them of the bounced check, the check number, the amount of the check, specifics related to the banking transaction (specifically, how many times it was presented to the bank and returned) and that this third party individual needed to contact me for immediate payment of the check and associated fees.  </p>
<p>I was shocked that the booster club never notified me directly by phone or letter or email to inform me of the check and request alternative payment.  Instead went to another individual, who just happens to know me personally, to collect on a debt.  </p>
<p>I asked the individual, who contacted me regarding the above issue, for the direct contact information of the Treasurer and I was refused.  Instead this individual provided my phone number to the Treasurer without my permission.  </p>
<p>I checked my banking account today and the check was presented for the second time and payment cleared (funds have always been available since March 22, 2011).  I realize that the first time the check was presented was completely my fault; however, the check was presented a month later.  Although I am aware a check is good for a &#8220;very long time&#8221; after writing it, it should not have taken a month to be presented for payment.  This being the reason I believed payment had been cleared a month prior. </p>
<p>Have any Privacy Protection Laws or Codes been violated here?  I feel that I should have at the least been notified first! </p>
<p>Do I have any recourse against the school&#8217;s booster club or Treasurer?  </p>
<p>Should I send a strong language letter to the booster club informing them how inappropriate their conduct was?</p>
<p>Or, am I completely over-reacting?!</p>

<div>Ok. here I go with another Thread.</p>
<p>As  restaurant owner I made a contract with a company that provide aprons, towels, etc.</p>
<p>I&#8217;t has been a little over a year since I singed the contract. I decided to cancel their services for the following:</p>
<p>Damage towels: Towels that were used wrongfully, meaning they cant not be used in the kitchen to clean up any kind of grease or oil.  I had a couple of conversations with the owner of the company that provides those services, we discussed the problem regarding those towels been charge and those damage towels were never showed to me to verify such damages; meaning if you get charge for any damage products you get to KEEP them after you pay full price for them then it is yours now. Also on that phone conversation I told the owner <b>&#8220;can you tell your delivery guy to bring me my damage towels that I have been charged for&#8221;</b> his answer was <b>&#8220;sure let me call him and tell him to stop by and give them to you, and I call you with an answer of when he will do that&#8221;.</b></p>
<p>All invoices were paid in full/cash money. So for me to help remedy the problem I told the owner of that company on that phone call, <b>&#8220;let&#8217;s add more grill pads  instead of regular towels so I wont keep getting charged for damage towels&#8221;.</b> Grill pads can be used any where and you can clean  oils spills, grease, etc. And also to help  remedy the problem we separated aprons, regular towels, and grill pads on different  bags. So when the delivery guy comes in next week he can see for himself that all products are separated so it will make it easier for him to find any damage towels BEFORE putting them in the back of his delivery truck.</p>
<p>After a few weeks we started to get charged again. Every other week I saw a  total charge of $2-$3 for the damage towels. </p>
<p>It was over a month and I never heard from the owner on WHEN my damage towels will be shown to me, so damage towels were still been charged but never delivered to me. So with that poor of a service and  because of those charges of damage towels I decided to cancel their services. so in the last week of  march of this year I decided to send him a certified letter stating the reason of cancellation of services.</p>
<p>I mentioned on that letter that on the next service day he can go ahead and pick up their stuff and leave and of course no more  invoices will be payed. So the next service day, the delivery guy came in and my manager/brother told him to not deliver any clean inventory anymore and to pick all dirty inventory, he left with his clean inventory and left the dirty inventory inside of my premises. The day after the delivery guy came in with his business card and a copy of the 5 year contract later on that day the owner NOW is trying to contact me to see whats going on, he called my two businesses my cellphone number and showed up to another of my restaurants that he does not provide services to. I did not answered any of his calls at all. I mean why should I when he doesnt really care about getting back to me when he is asked for so i can see my damage towels.</p>
<p>After a few days he sent me a certified letter saying that contract was breach.</p>
<p><b>In the contract says the following:</p>
<p>Should the customer, at any time, believe that this company has failed to provide such service, the customer shall notify the company by certified mail, stating the nature of the complain. Should the company fail to remedy the complaint within 30 days of receipt, customer may terminate our service agreement via written notice, certified mail.</b></p>
<p>Ok, I did sent the cancellation of services letter via certified mail. I did not sent the complaint via certified mail. Why? because the owner and I were on the phone more than once regarding the same problem. And I felt that after I asked for proof for those damage towels and him not giving them to me I had the right to cancel the services. I have a few invoices that proves that indeed I help on remedy the problem  by ordering more grill pad.</p>
<p>A week or Two after the delivery guy and another person (female) comes into my restaurant and he tolf my manager(brother) that he was there to pick up the dirty inventory he left a couple of weeks ago. The delivery guy and the female started counting aprons, regular towels, grill pads, etc. (<b>BUT he never asked my manager/brother to count those items with them</b>), then He went ahead and put them in the back of his delivery truck then he told my manager/brother that 9 aprons and 3 towels were missing and that he needed to sign a piece of paper, my brother did not sign it!</p>
<p>When I told the owner that on the next service day he or his delivery guy can pick up their stuff I already talked to another company  about providing the same type of services, this company services my other location and I never, NEVER had a problem with charges etc, etc for  over 3 years.</p>
<p>So, for us it did not make any sense whatsoever becasue we already had another company replacing that company with such poor service. So I was thinking &#8221; if he claims 9 aprons and 3 towels were missing he brought short the inventory on his last delivery day!&#8221;</p>
<p>The day after the owner shows up and he picked up all toilet paper dispensers, soap dispensers, etc. (all wall attachable items).</p>
<p>
A few days after that I received a bill from them with the full amount for the remaining of the contract, which is around $12k.</p>
<p>I responded  to him via certified mail and I explain  in more details the reason of my cancellation.</p>
<p>A few days later I received a certified letter from his attorney and they mention that the provision that allows for termination of the Agreement makes it very clear that the customer shall notify the company by certified mail regarding the nature of the complaint then the company has 30 days to remedy the complaint before I may terminate the Agreement.</p>
<p>
Also in the attorney&#8217;s letter they said that the company continued to fulfill their obligations under the Agreement, Each week for three weeks and that their attempted to make the regularly scheduled deliveries. and their services were refused during each of those attempts. THEY NEVER ATTEMPTED TO DELIVER ANY SERVICES AT ALL THATS A LIE!</p>
<p>Also in the lawyer&#8217;s letter is says that in regards of the 9 missing aprons and towels that  I WAS NOT PRESENT THAT DAY  and that my manager/brother WAS asked to observe the counting of the inventory. That my manager/brother indicated that, at your specific direction, he could not accommodate that request.<br />
LIE AGAIN he came home that night and he explain everything to me!</p>
<p>And then they mention again that I should sent a complaint first via certified mail. And that i clearly did not comply with the terms of the Agreement regarding the termination, and therefore the Agreement has been wrongfully terminated by me.</p>
<p>Also in the lawyer&#8217;s letter says: Demand is hereby made, that by close of business on Friday, may 13 of this year i send a cashiers check for  the sum of $6,000.00. and to be advised that failure to cooperate will result of office pursuing every appropriate legal and equitable remedy available to my client.</p>
<p>And lastly.  the said that Their client wishes me to know that to resolve this matter, it remains willing to discuss the full reinstatement of the services that was provided  pursuant to the agreement. That if I am interested in that venue, to please contact the lawyer ASAP so that we can work out the details.</p>
<p>
What should I do?</p>
<p>I heard form another business that they have the same problem with this company!</p>

They want me to pay $750 for the business they lost. They are holding my paycheck until I have a meeting with them but the paycheck is only going to be like $50. They are a law firm and said it wouldn&#8217;t cost them anything to sue me. Can they even sue me for anything?</div>

<p>Ok Hubby just got a call from a CA handling a Tmobile bill that I know we owe but here is the deal.</p>
<p> </p>
<p>I was trying to work with Tmobile b/c I was not paying eartly term fees on these lines as we weren&#8217;t getting good signal at all.</p>
<p> </p>
<p>The total bill is $1031.62  ( Past Due $483.23   Early Term $529.36  Other Fees  $107.13)</p>
<p> </p>
<p>They are offering my husband to pay $628.19 and they will take payments, to not report it to the CRAs.  He told them he would talk to me and I would call back, the person he talked to (RA) told him it had to be done by the 20th.</p>
<p> </p>
<p>I called and asked for (RA &#8211; using his extension) and spoke to (SC) as RA wasn&#8217;t available.   He gave me the payoff number to not report it as $625.00 and they might do payment plans but I need to do it right now.  When I said I need to see a bill/breakdown of the monies as I couldn&#8217;t find my paperwork and needed to compare the numbers &#8211; he said he would but I wouldn&#8217;t get it before they sent it to the CRA. I told couldn&#8217;t do it right then I needed to look at my budget before I do anything.  At that point their &#8220;supervisor&#8221; (MJ) gets on the phone and tells me that he spoke to (RA) and they both told my husband it needed to be paid TODAY or being reported to CRA TODAY.  He said I couldn&#8217;t mail in anything except balance in full, I would have to do something over the phone TODAY if I wanted the payment arrangement and it NOT to be reported.</p>
<p> </p>
<p>UGH I called Tmobile directly and foundout that it is a written off/closed account &#8211; so I am assuming it was sold to the CA.  It is upsetting as TMobile offered to take of $600.00 and let me make arrangements if it hadn&#8217;t been written off and just placed with a CA, but since it was sold they can&#8217;t. </p>

<p>I honestly thought I had sent them a letter (TMobile) stating that I would pay the Past Due but just NOT the Early Term or other Fees.  I guess it all slipped my mind.</p>

<p>EDIT:  I have found their email but now I am not sure if hubby verbally agreed to the total of the debt or to pay the debt. I know he doesn&#8217;t want it on the CR and we both agree that we need to pay the Past Due Amount.  PLEASE PLEASE HELP I am getting sick to my stomach </p>

<div>My Grandmother, who is 80+ years old, had an insurance contract that ran from 2007 to 2008. At the end of the contract in 2008, she never received another bill and stopped paying, since she stopped driving. My mother took over paying her bills about 4 months ago. About 3 months ago, the insurance company sent her a letter saying that although they never received another bill, that the policy had still been in effect and that she owed the insurance company $8500 or they were going to send her into collections. Also in this time frame they raised her premium rate with no consultation. The insurance company has acknowledged on the phone that her failure to receive any bills from them was a &#8220;glitch&#8221; in their system. So my question is, is my grandmother responsible for the full amount or do we have some legal recourse? She did renew the cars registration, which leads me to believe that she was in fact insured, but she&#8217;s 80+ years old and did not connect the fact she had a policy in effect. Thanks for any advice!</div>

My mom and I were arguing over something trivial and my uncle got involved. I told him to mind his business because he wasn&#8217;t my father and shouldn&#8217;t start acting like one now. We argued for about 2 minuted when he got up out of his chair and walked over to me and started yelling in my face. I told him to get out of my space and he responded by putting his hands around my neck as if to choke me. Then instead of applying force to my neck he grabbed my arms and dragged me out of the chair and continued to push me and grip my wrists extremely tightly. I yelled at him to get his hands off of me and that I was going to call the cops. He laughed and said fine they aren&#8217;t going to do anything. I got my phone and ran outside and called 911. The police got there and said that because my mother didn&#8217;t tell him to stop and because she told them I was going to attack her it was legal because my uncle was preventing me from attacking her. (I had no intention of attacking her; I never got out of my chair or threatened her and was only out of my chair when I was dragged from it.) I don&#8217;t understand how it can be legal for him to assault me and not have anything happen to him for it. I called child protective services and they said it&#8217;s not their department. I don&#8217;t know what to do, but I will not accept that this is legal. I&#8217;m sixteen years old and live in the state of Maine.:confused:</div>

<div>Back in August 2010, my now former BF took my perfectly good Honda motorcycle, which was in my name (and paid in full) and traded it in at the a local Harley Davidson dealer ship on a Tuesday.  On Thursday he surprised me with this gift because he didn&#8217;t like hearing from me that &#8220;when i turn 50 I&#8217;ll have my harley&#8221; (I&#8217;m currently 45).  He stated at the moment he gave it to me that he would take care of the payments &#038; insurance (and has done so all along) and that if this relationship did not work out that he would pay off the bike.  I have several friend that he also stated this to.  He also gave me the title and all the paper work to keep in my files. He did not sign the title.</p>
<p>We have since parted about a month ago, and I have an email trail that he took out his city (NY) annuity to pay of  the bike and will terminate the insurance so that we no longer have to deal each other and go our separate ways.  He has since changed his mind and wants the bike back. </p>
<p>I also have it in the same email trail that he stated &#8220;it was a gift&#8221; to me and now wants it back because it was for someone that he thought loved him.</p>
<p>I told him over the phone that if he wanted the bike we would have to go to court and he said he didn&#8217;t want to take that route and needed to think about this.  That was on Sat. April 9th and have not hear anything to date.</p>
<p>Is the law on my side?</p></div>

<div>I live in a community of townhouses and my next door neighbor rented out his home to people who have violated almost every bylaw of the HOA. Ever since they moved here in November, its been nothing but noise, garbage, fire hazards from discarded cigarettes and inappropriate vulgar language. They were asked to stop disposing lit cigarettes outside very nicely, so they started throwing them in the back, an area prone to brush fires.  When they are not having a domestic dispute, they fight with various neighbors, the parcel delivery man, cabbies, and/or on the phone with someone else.  This has been ongoing almost daily since November. During one very chaotic scene, an individual from their home was taken into custody by 5+ NYPD squad cars. There are public records of members of their family being arrested for burglarly.  Not to mention, I had to file a police report against these tenants for harassment twice.  They accused me of running over someone from their household, a female from the home threatened myself and my family, verbally attacked and threatened a contractor I had hired to build a fence in my backyard. Their landlord was contacted on several occasions, but instead of abating the problem, he made it worse. He told them that it was us specifically complaining while it was from the entire HOA, he put my whole family in danger.  The problem got so out of hand the HOA organized an emergency meeting with the landlord and he begged us to give them one more chance.  My family along with the HOA members agreed under the circumstances that they will stop being a nuisance, no longer harass any neighbors and they will behave according to our neighborhood bylaws.  A few days passed, and they broke their agreement, a female from the home started blasting music so loud the walls in our homes shook, it was so loud an awning from the chandelier in our home fell off.  In fact, as I am posting this thread, the woman is yelling at the top of her lungs outside again.  Please advise me on what I can do, I feel like a helpless prisoner in my own home, totally lost the enjoyment of my property. :dunno:</div>

<div>I was in an accident with no insurance (though I have it now). The other party involved did not contact me about any payments nor did thier insurance, so when I recieved a letter from the DOT stating I had to give them my insurance information I called to see what I needed to do since I did not have any at the time. They stated that I had to get into contact with the owner or thier insurance company so I called thier insurance company. They informed me that there was no claim made so I filed a lost claim. After getting of the phone the insurance company called me back to tell me the owner wanted me to call them, so I did. When I asked if she had gotten an estimate on the damages to the car she stated she had sold it the next day for $300 less than originaly intended &#038; stated they wanted me to pay that. I called the DOT again to see what my options were &#038; they are to either set up a payment plan or the owner has to sign a release of liability. I also called my insurance company &#038; they informed me that if it had been through the insurance company they would not be paying the $300 because it could be more than what the damages would have cost &#038; because it was thier responsability to get an estimate. </p>
<p>I guess what I&#8217;m asking is if she did not get an estimate on the car&#8217;s damages before selling it the next day should I have to pay for her personal loss of $300 in selling the car or is that not my responsability since she had the oprotunity to get an estimate before selling the car?</p></div>
