marijuane possession
i was stopped on hyway 401 by the opp on may 19th 2010 because the officer thought we were smoking a cigarette with a baby seat in the car while explaning to us why he stopped us he found a flake of marijuana in the side of the passengers seat (who was unaware of me having any pot)at wich point he told us we were under arrest for possession . he asked me if i had any more with me .

declining a breathalyzer
If a person is riding in the passengers seat of a vehicle and that vehicle gets pulled over, can the passenger decline a breathalyzer test if asked to take one?

Possession of a Stolen Vehicle
My question involves criminal law for the state of California I was recently on a jury (the trial is now complete) where we had to determine guilt on the following changes: Charge number 1: theft of a motor vehicle Charge number 2: possession of a stolen motor vehicle We decided that we could not determine who stole the vehicle or who was driving the vehicle when it was stopped some time later. So we said not guilty to charge number 1
