<div>I&#8217;m not sure if a lawyer can help me, or how to describe it.  I just have to do something.  This may be a case of psychological cruelty to me and/or elder abuse to my mother.  I appreciate any advice I can get. </p>
<p>My mom died last year of cancer.  My sister was given medical decision rights.  My sister and I absolutely despise each other.  My sister used her position in an abusive manner.  </p>
<p>I was excluded from medical information, updates, or decisions.  My sister lobbied family members, nurses and the social worker for the hospital to sector me out.  When I insisted on being included she threatened &#8220;I&#8217;ll have you hurt so bad that you won&#8217;t believe it&#8221;.  Her husband made me leave the hospital room using threatening body language.  My sister arranged for our cousins to intimidate me and keep me in check.  The social worker took me aside to lecture me.  The nurse in the ICU was explicitly disrespectful to me.  </p>
<p>I never did anything whatsoever to precipitate any of this, in word or deed.  It was all based on my sister&#8217;s vindictive characterization of me as a &#8220;problem&#8221;.  I sensed I was being harrassed in order to get me to react so they could have me thrown out.  I refused to take the bait and it just escalated.  </p>
<p>Here is the worst part. </p>
<p>On my mom&#8217;s last day she talked to my sister.  I stood behind her waiting my turn.  My sister hissed at me GET OUT with fury in her face.  I walked away and waited 10 minutes.  </p>
<p>My sister came out so I went in to talk to my mom.  As I walked towards the bed I saw my sister whisper something to the nurse on the way out.  I believe what she whispered to the nurse precipitated the following outrage.</p>
<p>I started my last conversation with my mom and the nurse snuck in from the side slipping a tight fitting air mask over my moms face.  My mother struggled trying to get it off so she could talk to me.  I tried to pull it off but I couldnt.  I was in shock.  I felt helpless.  I didn&#8217;t know what to do.  I had no one friendly to turn to.  Looking back I should have cut the mask off.  I hate myself for not doing it.  It was her last day.  I was kept from getting to say goodbye.  She never talked to anyone after that.  Her last conscious moments were struggling and despair like she was drowning.  It may have caused her to die sooner.  </p>
<p>I think the nurse waited behind the curtain to deliberately cut my mom off at the worst possible time during our conversation.  I told my mom you are the most important person in the world to me, I&#8217;ll miss you so much, and I want you to picture me successful and happy.  She said its ok even if you&#8217;re not.  Then she said &#8220;it&#8217;s all trial and error&#8221;.  I didn&#8217;t understand what she meant.  I sensed she thought she might have given the wrong impression so she started to explain herself but right at that exact moment the nurse popped in, put the mask over mom&#8217;s face VERY quickly, and walked away.  She didnt give my mom any warning.  The nurse never said a word to me about why she did it.   She just threw it over my mom&#8217;s face, turned her back and walked away; no explanation.  </p>
<p>I knew the nurse&#8217;s motives were sadistic because earlier I took her aside and asked if I could get the latest medical update on my mom&#8217;s condition.  she snarled at me you get that through your doctor.  She turned her back on me and roughly threw the curtain shut.  She had a hostile tone and body language right in front of my mother.  Moments later she commented under her breath &#8220;I&#8217;m a bitch&#8221; for me to hear.  I got the sense she was deliberately trying to provoke me so that she could kick me out.  I refused to take the bait.  I didn&#8217;t dare take any of it.  I just withstood horrible abuse so that I could be near my mother.</p>
<p>Can I sue my sister?  The nurse?  The hospital?  Thx for reading.</p></div>

<div>Posted recently here is the latest. My friend was fired today from an assisted living. She worked as an admin. assistant at night. She looked after all of the residents and they all had a special connection with her. Last week she noticed that one resident was given 2 pills &#8211; and the resident questioned the nurse and said &#8216;I don&#8217;t get 2 pills&#8217; &#8211; but the nurse said well tonight you are! My friend called me the next day and said that the other pill whatever is was made the resident unsteady on her feet. Turns out it was a sleeping pill they gave her, something she never gets. Anyway &#8211; she called the family and they were upset that they did not get a phone call since this medication is to be given with family authorization, it is as needed, or PRN. My friend was fired for calling the family. She said they told her she is fired for giving out inaccurate medical information. The truth &#8211; they got caught &#8211; and the person that gave the medication should have been fired. Does she have any rights?</div>

<div>I have a friend who was working with a nursing travel company. The company was taking money out of her account for rent. She decided to leave from her contract early by five week for personnel reasons. She left the apartment on the 31st of July but when she returned home she found that the travel company had taken another months rent out of her checking account. She had a room mate that was living with her and was also leaving that night but when she discovered that the rent had been taken out she call her room mate and told her it was fine to stay there because the rent had been paid for the month. On the third of August the managers came over and told her room mate she had to move out of sign a new lease because the travel company asked for the money back. The room mate signed a new lease and now lives there on her own income. The problem is that my friend did not get the money for the rent returned to her. When she called the company they said they would look in to it but had a rude and uninterested tone about the issue. After talking to other nurse who had lived in the apartment through this company she found that they often continue to take money out of peoples accounts after they leave and do not return the money. The amount is about 1300 and if that money was not used for the rent of the apartment then where did it go and would it be returnable if they refuse to re credit my friends account?</div>

<div>I recently started a job as an LPN at the facility that I worked as an aide. I had my training with a nurse who talked about about me openly in fron of student nurses, visiting family members, and other workers. I was told by a person who heard everything. The same day I went and requested not to be trained by the same nurse but the next day, they put me back with her. That morning another worker pulled me to the side and told me that nurse was up there belittling me in front of everybody. I had a horrible day and I stupidly confronted her crying. She denied ever saying anything, then she confessed and told me she &#8220;had every right to talk about me&#8221; and that the family members wouldn&#8217;t know she was talking about me. I was shocked so on my break I went and told my director. The assumption that they all had was they confused me with another nurse who was an experienced nurse and that they were laughing at me because they thought practically I was dump. The next day the assistant director came and apologize claiming they didnt know I was a new grad. Thats when I realized the nurses supervisor and the assistant director were present when the nurse training me made comments about me. I know there are gossips in he workplace but this has created a hostile environment because none of the nurses communicate with me. I am the youngest there and I&#8217;m also black and this gossip and unfair treatment I received has traveled facility including different shifts about me, now most of the people know this about me. I dont feel comfortable working there and  I want to know if I have a case for for discrimination.</div>

<div>I work as a nurse in a nursing home. One of my residents fell to the floor. I called for a PT to come help me get her up. With four of us, we did get her up but later that day I noticed my back started to hurt a little. I didn&#8217;t think anything of it and figured it would go away. My back has gradually gotten worse. Two weeks later went to a Chiropractor then to a MD. Was told by the Chiropractor that I had a vertebrae out. Now today 4 weeks later and several adjustments my back is getting worse and showing symptoms of a herniated disk. (Have another MD appt in AM) My question is, is is too late to fill out an incident report at work and hold them liable for my medical bills?</div>

<div>When my wife and I split up this past summer, she took our Nurse Practitioner with her to court.  She got the NP to file stalking allegations on me as well as my wife filing a RO.  </p>
<p>Without getting into the whole story, which was bogus anyway, at the court hearing the NP said that she had treated me for herpes and back pain.  I got a CD of the conversation as well as the transcript.  I felt that my privacy rights had been violated in a terrible way.</p>
<p>I sent the information to the district Office of Civil Rights who responded to me that they would conduct an investigation.</p>
<p>When I got the summary of the investigation the other day, the NP admitted that more information was given than allowed.  She had to review the rules, do a question/answer test of some type, which she passed and the case was closed (so a slap on the hand is all she got).</p>
<p>But because it was found that she violated my HIPAA privacy rights by the OCR and the fact that she admitted it, I am curious about suing her.  I wouldn&#8217;t have been nearly as offended if she had said she treated me for shingles, which is true.  She didn&#8217;t even specify the type of herpes and now my medical condition is part of public record.:blush:blush</p>
<p>I&#8217;m still pissed and wondering what to do.  Would it not be worth it to sue her?  And, what is your experience with such matters.</p>
