<div>Is this verbal contract enforceable? <br />
Can a contract be enforceable when one party does not have a copy of the contract &#8211; even after repeated requests?<br />
Is online advertising considered &#8220;goods&#8221; as would pertain to the Statute of Frauds in North Carolina?</p>
<p>Background: I am a North Carolina resident, part-time Realtor, and Kindergarten teaching assistant.<br />
On August 12, I entered into a 6 month contract with an online advertising company. The contract was recorded over the phone. I was advised I would receive a copy of the contract (this is actually stated by the company&#8217;s representative in the recording). EVEN AFTER REPEATED WRITTEN AND VERBAL REQUESTS, I did not receive a copy (or audio file) of the contract until I was contacted on April 5 (8 months later). The purpose of the communication from the company was to advise I was still under contract and obligated to continue paying the monthly fee of $219. When I communicated (via email) that my 6 month obligation was satisfied, I was advised (via email reply) that it was a MINIMUM 6 MONTH contract and I was required to provide a 15 day written notice to terminate after that initial term. <br />
Interestingly, the company stopped billing my credit card after the initial 6 month term, which ended in January. I believed the contract was over.<br />
In addition to not sending the contract, the company failed to perform several services they promised. For example, during this Pay-Per-Click and Search-Engine-Optimization Campaign I never received the &#8220;Online Traffic&#8221; reports that would show when and how many clicks/searches were made relating to this marketing.<br />
There were many other issues &#8211; particularly during the first month of my &#8216;relationship&#8217; with this company.<br />

He was very abusive and she had no real friends or family there so he had separation papers created in which she agreed to pay him for medical debts she had accrued while married to him and presumably gave him parental rights. She then she moved back to the States. Around a year after being back she got pregnant with her boyfriend at the time and had a daughter. She broke up with him and we dated and she got pregnant with another daughter. We broke up for a time while she was pregnant and she went back to the previous boyfriend whom she had had her other daughter with and he signed the birth certificate for my daughter. We are now back together and trying to straighten out the details of parental rights and such. We have talked to social services and the child support enforcement agency. Social service&#8217;s lawyer says since she is technically still married the children are her husbands no matter what a paternity test might prove and they seem unwilling to spend any time investigating whether her husband has followed through with a divorce. She did get legal papers from him a few years ago but they were not in English so she could not read them and now has lost the papers. Child support agency says they will only open a case for child support payments and that would in no way affect parental rights. She desperately wants to get a divorce and get parental rights corrected for both of her daughters and receive child support from her ex-boyfriend. We are both working but have a lot of debt and not much income. We are poor and in a terribly complex situation causing the both of us a lot of mental and emotional stress. I want her ex-boyfriend off my daughters birth certificate and parental rights to her. She wants a divorce, child support for her other daughter, and a correct birth certificate for our daughter. We are so lost right now and I&#8217;m trying to reach out for any kind of help possible. I know we are going to need a lawyer to sort all of this out but we literally cannot afford one for the foreseeable future. Please please please help us.</div>

<div>I had a kid when I was 16. Never married the babies momma but we were together for about 3 years after. We had the baby in MA then moved to FL and broke up down there. We went to mediation and got everything hashed out with child support and visiting rights. I moved back to MA/NH and we went through some more problems and she didn&#8217;t want me to see my daughter anymore. I stopped paying child support and haven&#8217;t seen my daughter in over 2 years. Ive moved on and now considering giving up my parental rights. Early on when we first went through mediation she told me that if I were to leave and forget about my daughter that she would not go after me. I will be asking her for that deal. Question is. </p>
<p>After a mediation court order goes through can it be terminated? Or after child support is started can it be stopped even if money is owed?</p>
<p>How do I go about changing the court order with out a lawyer as I can not afford one?</p>
<p>She has moved to North Carolina and resides there now. Do I still go through with this in Florida or where she resides?</p>

<div>Im 16 (17 in September) and I really have a strong need to get emancipated. First off, I live in North Carolina. My mother is mentally abusive. If I do something that she doesnt like (from failing my math exam to not putting a plate in the dishwasher) that im a disappointment and that she can&#8217;t stand to even look at me. Shes called me cow, a b&#8212;&#8211; and told me I was never going to be anything. She has told me that she should start beating me to get her point across and that she was going to make it where I wouldnt have any contact with the outside world. She&#8217;s also said she wanted to kill me a few times. She has threw glasses and phones towards me. My step-father is constantly yelling at me and threatening to knock my teeth down my throat. My mother has told me that if I ever tell anyone or call social services she&#8217;ll find me and beat me to death. I don&#8217;t know what to do. A few weeks ago I broke and started crying to my cousin about everything that was going on and my great-aunt read the chat conversation and has offered to help me and let me live with her. Mom acts like a totally different person in public, just the sweetest and happiest person you&#8217;ve ever met but once shes alone with me she starts everything again. Is there anyway to go around the legal constent of a parent to get emancipated? Or is there any other option I have to get away? Could I possibly file for emancipation and stay with my Aunt until I am emancipated? If she finds out im looking for a way out im afraid she&#8217;ll beat me and make my life even more horrible. I dont have access to a school counselor (im a online high school student) and calling child services and having a discussion with them is out of the question because she is constantly around. I need a quick and clean way out where there isnt a possibility of me ever having to be around her again. Please help me.</div>

<div>You may think hostage is a strong term, but it true. I&#8217;ve been divorce over 4 yrs. The ex gets visitation, yet he plays this sick game of either not showing up to pick the kids up or he doesn&#8217;t show to drop them off.<br />
Its this sick game he plays and I have fought and fought this in the court system. They hold him in contempt but all he gets is a slap on the hand.<br />
My attorney advised me to make a visitation schedule and provide him and the court with copies- I did. He ignores the paper. He shows whenever- the kids are 7,8 and dont want to see him and beg and cry not to go. Since July, visitation has only gotten worse.<br />
He is suppose to return the kids to me today at 12pm in Lexington. He says he will not be there and that if I want them back I have to come to him in Casey county. He read the papers wrong and drove to Lexington yesterday at 12pm to return them- he&#8217;s fault, not mine. The kids and I live 1 1/2 hrs North of Lexington and he lives 1 1/2 hrs South. If I could have been there in minutes and he would wait- i would have gotten them in a heartbeat- but thats the thing, he knew I wouldnt be there and he wasnt planning on waiting.<br />
He did this last year. Always a holiday weekend and the police never seem to help me out- they always call him up- and it becomes &#8220;he said she said&#8221;. Then they say let the courts handle it- in the meantime, what about my kids?<br />
He wants me to go to Casey county to cost me more in gas, to control me by using the kids and its a small town, Police there are &#8220;his friends&#8221; and will not protect me- years ago he choked me in front of a police officer and nothing was done about it- the officer didnt help me, they wouldnt even give me an EPO, so me and the kids got permission to leave that county. I fear for my life whenever I have to go down there for court- I asked for a change of venue and the Judge denied it, saying that the ex lives 10 min away- its my case! Everytime I go, its to hold him in contempt for something he did or did not do, my atty has explained to the court that its my case, that Im being punished everytime I have to come down because I loose a day of work, and have to drive 6 hrs RT- I always get awarded atty fees- but I still have to pay her and he still has never reimbursed ($2000 currently).<br />
What can I do? When will the legal system stop allowing him to abuse me and the kids?</div>

<div>My wife and I are renting a house in North Carolina.  In order to help pay the bills and such we took on a coworker of mine as a tenant.  My wife and I knew he was going to be living with us when we got the house and it is currently outside of our ability to pay for on our own.  My coworker told us on the 10th that he is going to be moving by the end of the month.  Is there anything we can due since we only got this size of a house because we were all going to be living here.  He had originally told us he would be staying for the entire year.  We are both in the Army and he isn&#8217;t getting his housing allowance that he was promised for his reenlistment.  My wife and I are at a loss and we dont know what to do from here.</div>

<div>Hello all, thanks for reading.<br />
My husband and I bought a used vehicle from a private owner in Virginia (we live in North Carolina). Before purchasing the vehicle we spoke with a Service Representative of the dealership where the car has been serviced for the past six years. He assured us the car was in perfect mechanical shape and explained the transmission had been replaced a little over a year ago, that a computer had been reset and it needed to learn our driving habits so it would shudder a little. His statements gave us the confidence to make the investment.</p>
<p>After a month of requesting the service history and contacting higher management at that dealership, we finally received the records. We had it serviced and it turns out that shuddering is because it needs a new transmission (cost is 8,000 dollars). Do we have a case, being that a Service representative stated that the car was in perfect shape? This would be the fourth transmission for this car, and it has less than 100,000 miles on it. Can we sue the dealership for giving the vehicle a &#8216;clean bill&#8217;? <br />

<p>Recently another individual has starting operating as Carolina Entertainment in South Carolina.</p>
<p>Originally it wasn&#8217;t a pressing issue but&#8230; recently he purchased carolinaentertainment.com as his website domain.</p>
<p>We operate under carolina-inc.com as it&#8217;s shorter and at the domain a domain seller had carolinaentertainment.com and wante $3,000 for it.</p>
<p>Now clients are getting us confused &#038; he&#8217;s getting mu business.</p>
<p>To prevent this, I&#8217;ve filled for a Trademark of Carolina Entertainment with the USPTO. It has live status via the USPTO Website (85130700), but has yet to be reviewed and approved by them.</p>
<p>Do I need to wait for that until I ask the other party to cease &#038; desist? Do I have any rights to his domain?</p>
