my partner recently died and he has not left a will, we have been together for 12 years but i have not divorsed my husband from before him so i am still leagly marrid to him and not my partner that has died. i have been trying to find out where this leaves me in regards to his estate, as he has two grown up children. we have a joint bank account, there is a car in his name and he has some bonds and things. we live in a council house there is no problem there but what about the items that are in the house and belonged to him. would like a bit of information if possible. thanks

I have been charged with a larceny over 200 under 1000. I went onto the property of the plaintiff and was looking at old farm equiptment that was junk, sunken into the ground, not used for 10+ yrs. I moved some of the items but NEVER took them off the property. Will this larceny stand in court?

I was arrested for retail theft after a security guard called my home accussing me of theft 5 days after I was in the store shopping with a friend! He said “somebody” recognized me on a security tape and thats how he tracked me down! He said they did an inventory of one of the items I was trying on and when I left they were missing one, then accused me of taking it! I remained in the store for a long while after trying the items on, I bought items and waited for them to be gift wrapped even! I told him that he was seriously mistaken! The only things I left that store with I PAYED FOR!And He wanted me to come in so he could have a ticket issued! I objected to this of course and wks later I was arrested and jailed at my home in front of my children! I have pled not guilty to the theft charge. Is it possible to be found guilty of this! There cant be any kind of proof or evidence of me stealing anything because IT NEVER HAPPENED! The judge asked me if I had a lawyer to represent me at the bench trial! I was stunned! Didnt know what to say! I assumed I wouldnt need one in this open and shut case! And isnt this a form of false arrest? How was a warrant even issued? Theres no possible way that theres any kind of evidence against me! I didnt commit any crime! Do I need a lawyer?

I was arrested for retail theft. I went into a grocery store when i found out that I had got a raise at work. Happy, i was going to treat myself to a steak and a bag of good coffee. I had no cart to put the items in because that is all i planned to get. After getting the items i thought i better get some pop also. While walking over to the pop isle i place the steak and coffee in my coat. this way i could carry the case of pop.
When i got to the pop i noticed that the price must have been wrong. I approached a store clerk and asked about the cost. He said it was wrong and he would fix it. He said he would go get it for me. I told him, “I will get it later” then walked away from him with the intent to go get a cart to put my two items in along with the pop when i went back. I also figured I would get some fresh mushrooms to go with my steak. When I started to walk away to get a cart and the mushrooms, the store clerk told me “Come with me sir”. I told him i was not done shopping. I told him i needed a cart because I wanted more stuff. I turned around and again began to walk and get a cart. Again the clerk said come with me sir. I asked him what this was about and he said you know why sir. I was brought to an office and the police were called. I told them I had not finished shopping, that I wasnt trying to leave the store, that I didnt even walk toward the exit or through or past the checkout . What are my chances of beating these charges ?

(a) conceals upon his or her person or among his or her belongings, unpurchased merchandise displayed, held, stored or offered for sale in a retail mercantile establishment; and
(b) removes that merchandise beyond the last known station for receiving payments for that merchandise in that retail mercantile establishment such person shall be presumed to have possessed, carried away or transferred such merchandise with the intention of retaining it or with the intention of depriving the merchant permanently of the possession, use or benefit of such merchandise without paying the full retail value of such merchandise.

Upon leaving WalMart today I was surrounded by three police cars saying they wanted to talk to me about three laptops that were taken YESTERDAY. I asked if I was being arrested and they said “No, you’re being detained”. They said I was on tape pushing a cart past the “point of purchase” between 12:00 and 1:00 the previous day. I explained that yes, being down on my luck and having been jobless for a good deal of time after my company closed down operations I saw them as a chance to make some money.

I also told him I did go past the point of purchase with no one stopping me and the alarms didn’t go off. Once outside the doors of the store I had a change of heart and just left the cart. I told him I am on the tape, but I know I am not on a tape putting the items in my car and I am unaware of what happened to the cart once I had left. The response was it didn’t matter because my going past the point of purchase was all they needed. One officer told me to wait while the others watched me and he was going inside to view the tape and when he came back out I would be going to jail.

After about 20 minutes he returned, took info from my drivers license, my 12 year old son’s info, and my 21 year old Godson. We were never searched, handcuffed, or anything. I was told we were free to go and expect a call from the Police in a few days. This is puzzling because I never heard of this before. Why wasn’t I arrested on the spot and charged? No one ever itemized the items so how could they even come up with a dollar amount if nothing was inventoried?

I am 56, have no kind of prior record, don’t drink or do drugs. I don’t even smoke cigarettes. I realize it was foolish of me to even think of doing something like that. I won’t go into all of what I’m dealing with on a personal level that lead me to this because as one officer said when I tried to explain my rationale. “I personally don’t give a shit about you or your sad little story”

Can someone advise of what may happen next.

Recently, my relationship with my ex-girlfriend has been terminated. We were living together in Vermont, but after the issue that arose I could no longer stay in Vermont. I moved back to Florida with my family so I wouldn’t be homeless.

While living with my Ex, I had all my things there, now that we are no longer together and i am no longer in Vermont due to obvious reasons, I’m having trouble getting my things from her. I’ve sent her money that we agreed would be used to send my things, It’s been almost a month and we’ve had little to no contact since this. I have proof of cashing the check, receiving my check and depositing the money to be used for my items.

If she does not, or refuses to send my items, is there anything I could do?

I am a working mom with an ebay store. I was contacted by a buyer to make Alvin & the chipmunk cupcake toppers. So I did. Now I received an email stating that I need to pay a $300 as a settlement. I have asked the attorney, Stacy Papachristos IP assure, to mail me the documentation. Now she is staing that if she mails anything the $300 settlement will no longer be available. I am not sure what to do. I was under the impression that the sale of the items were fine under the fisrt sale doctrine. I can not afford an attorney nor the $300. Any advice you could give would be greatly appreciated.

I recently sold my old computer on craigslist for $550 (was originally listed at $600). The computer was listed as used, and also included “sold as is” in the description. A day after completing the sale, the buyer contacted me and stated that when plugging a few of his devices into the computers front USB ports, the computer damaged the items he plugged into them to the point where he stated he had to replace an external hard drive and his cell phone. I never used those front USB ports when I owned the computer, and had no knowledge of them causing damage to devices plugged into them. Upon further investigation into his claim, the buyer stated that his cell phone was now getting warm and not accepting a charge. When I looked up the common issues with his phone, that exact issue was listed under the FAQ for that device as a common issue with the phone when it is being used for prolonged periods of time – and as a safety feature the phone will not accept a charge when it is warm.

The buyer stated he wanted $180 to replace the items damaged ($50 for the hard drive and $130 for the phone). I told him I would pay him $50, to which he countered with $120 and then even went as low as $100. I refused and stated the most I would refund him back would be $50. He then filed a claim with PayPal (since thats how he paid for the computer) asking them to refund him $200. After he filed the claim, PayPal took the money from my account and put it on “hold” until the claim was over. I responded to PayPal with the details of the issue as I saw them. PayPal then gave back all my money and stated that they do not deal with these types of claims for items that are “not as described” for off ebay claims. I thought the issue was over at this point.

Today, 6 days later, the buyer contacts me again saying that he now wants the $50. I responded back to him that he had his opportunity to get $50 before trying to file a claim with PayPal, and now that deal is gone and I would not refund him any money at all. He stated that if I did not refund him at least the $50, he will take me to small claims court.
