<div>I was recently let go from my employer on Oct. 21, 2010 after working their since 2006. The reason was because I continued to call unemployment after returning to work. I was a teacher. The employer is an at will employer and it does state that in the employee handbook, I was not aware of that until after I was let go. Although I know of several other people who continued to call and recieve unemployment benefits after returning to work and they are still employee&#8217;s there.<br />
Now the 2008-2009 school year I was repeatedly harrassed by authority figures and I wrote letters letting them know what was going on but nothing was done. After I began writing the letters they began to pick on me. The following school year which was 2009-2010 was going good until that happened, now I was not actually aware of the clause in the handbook until I was let go. The company&#8217;s fiscal year is Nov1-Oct31. In Dec. 2010 we recieved checks from the 2009-2010 school year which was a COLA check and an enhancement check I receive those two. Another check came on Feb. 11, 2010 and after reviewing an old co-workers check stub it stated enhancement for 2009-2010 school year they said I was not entitled to funds even though I was there up until Oct. 21, 2010 which was still in the fiscal year.<br />
Do I have any type of case against this company?</div>

<div>I recently resigned (two-week notice) from my employer and, prior to the two-weeks being up, he got angry with me and fired me.  At the time I had 14 days of unused vacation time accrued.</p>
<p>My employer is incorporated in and operates in New York State.  In NYS an employer is obligated to pay out unused vacation time unless prior written notice has been given that specifies the conditions under which vacation time may be forfeited.</p>
<p>My employee handbook, which is very short and vaguely written in general, states that:</p>
<p>&#8220;Should you leave the employ of the Company, you may be eligible to collect pay in lieu of vacation time that has been earned but not taken. This will be determined by the circumstances surrounding termination of employement.&#8221;</p>
<p>And my employer is invoking this to deny me the vacation time I&#8217;m owed.</p>
<p>I am going to file a claim in Small Claims court if he continues to refuse to pay me for the time.  My argument is that this particular element of the handbook does not specify the conditions under which my vacation time is forfeited but rather allows my employer, carte blanche, to determine after the fact whether or not he wishes to pay out this time.  There is no clear expectation set or created under which I can determine if my time will or will not be paid.</p>
<p>Does anyone with any experience in these matters believe I have a case?</p>

<div>I have posted this in UI forum and am getting responses with regard to UI.  I&#8217;m posting here so that I can hopefully get some help with regard to filing a complaint.</p>
<p>I was fired from my job by my assistant manager. Mr (x)</p>
<p>Background:<br />
I have faced racial discrimination at my job. When I was made full-time it was said I got it because of my race. Other racist comments have been made. A customer would racially harass me. Other staff members complained to my assistant manager. He asked me if I wanted to take care of it myself. I said yes and didn&#8217;t do anything. I just wanted to let it go. He didn&#8217;t report it to HR. The manager who fired me has made racist jokes and I have said something about this to him before.</p>
<p>Incident:<br />
A server came into work to serve me papers in regard to a jointly held debt. I did not want to take the papers. The server figured it was for me and so he started shouting that if I didn&#8217;t take the papers he was going to get me fired. Then he started using racial slurs. He put his hand up to me and at that point I may or may not have pushed him.</p>
<p>Outcome:<br />
The police were called. The guy said I pushed him. The manager on duty, my supervisor and another staff member, who saw the incident, said they didn&#8217;t see me push him. The police told the server to leave and that was it. Mr (x) &#8216;investigated&#8217;. He asked all the staff members who had been on duty until he found one who said he had seen me push the server. He then fired me.</p>
<p>I called him the next day and tried to explain to him that I had been racially harassed. He said it wasn&#8217;t a racially motivated incident and quoted the handbook that said no harassment, by anyone, will be tolerated and is grounds for instant dismissal for an employee. <div>I was fired by my former employer several weeks ago, and I am trying to determine if the so called no compete paragraph which was in the employee handbook is binding.  I was made sign the handbook after 5 years of employment and at that time was given no consideration for signing.  The no compete states as follows &#8221; The employee agrees that for one year after termination or leaving, he/she will not give any information to any person, persons, company, partnership, or corporation about any accounts or business sources of company x.  Also the employee agrees that he/she will not sell, solict, or service any accounts or business sources of company x in x county or a fifty mile radius of x county for 1 year&#8221;.  Now the way I read this it does not acutally say that I cannot go to work for another company just that I cannot sell, solict, or service any of the customers of the company I had worked for for a year.  Am I reading this correctly?</div>
