I left my boyfriend and left all my things. Now he’s harrassing me to get my things out of his house, but won’t tell me when I can. Every day I pick he says “no” that won’t work. I lived and farmed there for 7 years. Everything I ever acquired is at that house; including appliances, farm equipment, saddles, horse tack, lawn furniture, house furniture, gym equipment, etc. It will take me about one full day to get all my things loaded up. I am willing to bring in whatever I need to get it done. There is NO “Joint” property whatsoever. I’m getting really tired of this game. What can I do ??

In 2010 I got pregnant and had the baby 9/2010, before I left on leave I was constantly told I was going to be fired from the HR Manager? (My work performance is great). So I finally confronted the CTO about this and she stated no such thing is occurring?
Upon my return there was no job for me, so I did odds and ends to fill up the day. I have 15 years of legal collection experience etc… I now do HR, (Something I have no idea about) but I am doing it and learning.
Everyday there is a constant belittling game that the owners do to me and I mean EVERY day. I have been told to do errands all over the city in my car no reimbursement on gas – nothing- I feel like this is retaliation for me having a baby as I have never been put in a situation like this before, I am a hard dedicated worker. I am trying my hardest everyday to get out of here but the interviews are not coming quick enough. There are so many issues that I can not list them all in a fourm. My main question is can companies really have the right to belittle and harass employees when they have a child or come back from leave?

I have proof that No one before me or after me has produced the numbers I did here, so there is no reason I should be going thru this based upon my work.

BTW. Many other people have left for leave and have come back to no consequences.

My friend and I are looking to develop a Trivia game for the iPhone. The game would flash screenshots of movies, video games and sports arenas and ask the end user to pick the correct answer. Would we be violating Copyright Laws by using these pictures / screenshots or would this fall under “Fair Use”? We do not intend on altering them in anyway but would charge a small fee to download the game. Thank you

A theoretical scenario: I go to a sporting event in which they are giving out free bobbleheads to the first 3,000 fans. If I were to leave my bobblehead at my seat when I went to the bathroom and someone snags it, they stole it right?

What about if I forget the bobblehead there and go to leave after the game. As I’m walking to the atrium, I remember it. I go back and find it is gone. It was stolen right?

Here is the scenario. Please don’t argue with me though about the premises. Been there and done that. Not Crazy, Not Lying.

I was being sued by a 3rd party notoriously deadbeat collector and their equally notorious deadbeat attorneys. The suit was about an alleged credit card I had with Citibank.

I have never had a citibank account so I denied everything in their Petition which may I say was put together with someone who appeared to have nothing beyond an elementary school education.

Anyway, I appeared pro se and played by the rules and did everything I was supposed to. I moved for a dismissal on the grounds of failure to state a claim and capacity to sue among other things. The only progress in the case from month to month was that we progressed to the next month to resume again a case wherein it seemed to object was to stall and frustrate me, which they did do.

Hizzoner was very thoughtful about continuing a meritless case for the benefit of plaintiff.

Finally the judge told me to come back in 3 months rather than the usual 1 month for trial. I asked the judge basically when do I finally get to see on what grounds this case has been filed, where’s the beef essentially is what I meant and he said at trial that’s when they show their cards (their cards are my words paraphrasing him). Not happy but whatever. Tired of paying $8 a day parking, going into the city environment I’m not comfortable in.

I had stuff to do so I made the most of it and was going to do a set of interrogatories but I figure no hurry, 3 months away. I already answered theirs. About a month passed and I decided to check casenet to see what this particular judge did with these cases (most of which no one shows up on, I was curious about the ones who did). I never found anyone who showed up actually. I also never found any resolution but Default Judgment. Then I looked at my own case and saw, surprise, a default judgment against me in September.

If we were to put the best face on this and just say it was a matter of confusion, seems like the judge could have/should have continued the case on my behalf for a change. I showed up every month while plaintiff stalled and got no where. If it was “just a misunderstanding” it seems based on the fact that I had perfect attendance prior to and there would be no logical reason for me to abandon ship when i was successful at forestalling this law firm who incidentally has an F rating with the BBB, and so the judge might have continued the case for me.

I’ve done extensive reading on the net and in similar circumstances the judges say they try to give pro se people a little extra rope to be sure they get a fair deal. I just ended up with Judge Roy Bean is all.

Ticked, angry, blah blah, shocked. It is obvious to me though no one else will accept what I say, they seem to automatically accept the judge is straight up and I am a liar but anyway. Assume for my sake that I’m telling the truth (and I am) how do I get this set aside/vacated? What are the chances a judge who colluded (please just work with me here) with the Plaintiff’s attorney to defraud me and the court is going to say “okay” I see what you mean when I ask that it be vacated based on the grounds that I was unaware of the hearing. He’s sure not going to say “you got me I’m a crook”.

Is there anyway at this point in the game to submit a motion to vacate and ask that it be assigned to a different judge or am I stuck with the crooked guy?

I have it on good authority that a process server has some papers with my name on it with the intent to cause me to show up and divulge all my earthly belongings so these 2 scummy people can take what I got and make it theres.

I don’t honestly see myself being able to do that because there is a metal detector just as you come into the building and so I don’t think I’d make it to that floor.

What can I do?

My sanity is hanging by a thread due to this and a home invasion recently and the fact that I have already been accused of being unfair to hizzoner so PLEASE don’t, I’ver heard it all a million times. :confused:

Also, forgot to ask, if I file a Motion to Vacate Default what happens with the hearing they want to have me appear?

If you accept my version of the truth (which I intend to prove in due time by getting a copy of the tape transcript) I hope see my “reluctance” to basically go and let these 2 crooks drool over my possessions.

I realize that any attorneys reading this may take offense at my disparagement of one of their colleagues but sometimes the truth hurts.

Three years ago my son suffered an injury on a school merry-go-round. The equipment was broken, ill maintained, and he was basically unsupervised at the time. He had to have surgery on his arm, 10 weeks in a cast, and spent a year wearing a brace. He has a permanent deformity to his arm. We discovered other children had also been hurt in the same manner on the same broken piece of equipment and requested the school’s insurance pay for his injuries.

We filed suit in 2009, after the school dug in its heels and did nothing.

We got to the stages of discovery, presentation of witness lists, and depositions. Our first deposition was supposed to be in February. The morning of our deposition, our attorney had a heart attack and they had to emergently halt the deposition process.

The depositions were rescheduled and performed in May after our attorney recovered. We read through the transcripts and signed off on them.

Their attorney asked what our first “offer” was for a settlement. I deferred to the attorney, who said he would get back to me.

Then nothing.

I called his office. My calls were not returned. I emailed with no response. I emailed both he and his secretary again, at which time FINALLY he informed me that he had had a second heart attack, had double bypass surgery, and was in the process of recovering. Oh, and by the way, his secretary no longer worked for him and he was just getting back to part-time status. He said he would have to review our case and get back to me.

That was 10 days ago.

Now what?? According to his secretary, the last time we met face-to-face, this was it. We were in the final stages and should have a resolution by now.

Instead, we’re getting no communication whatsoever.

What do we do now?? At this late stage of the game, can we request the case be moved to another attorney? Is that even an option, and would anyone even accept it?

On 7/10/2010 I had the legal right to retrieve my belongings from the premises by a court order.( I wiiling gave up the apartment w/o a fight) I went to my former address to get my belongings to put them into storage. When I got there my beds were out with the trash, and I started picking through the trash and a lot of my items were in the garbage, broken and destroyed. I found my daughter’s high school diploma in the garbage, there were clothes, and kitchen items, my son’s bike, my microwave unit, bins that held clothes, bookcases and things of that nature. When I spoke to the landlord who had an agreement to give me $200.00 to put my stuff in storage he basically stated that was the super trying to help by putting my things outside( in with the trash), I had to stop sanitation from removing the garbage. I took pictures of everything and I want to know is this legal. I’ve never encounter something like this. A lot of valuable items are missing and or destroyed. I had to shift through garbage to find items. When it all was shifted through I had only the things that were in my room. I had a two bedroom apartment, my daughter occupied the livingroom. ALL OF MY CHILDREN’S BELONGING AS FAR AS CLOTHES AND WINTER COATS AND SHOES, BOOTS, GAME COONSOLES AND IPHONES, AND SIDEKICKS WEREN’T RECOVERED. I was told by the judge I had the right to sue in Civil Court but since I owed about 3k in rent arrears and the marshal fee’s totaled 1500, it would cancel out whatever would be due to me. I want to know if the information I was given is correct. I did some research and discovered I could win triple my damages in Civil court if I were to win. All of my paperwork was thrown out. My cat is missing and so are my two turtles, Never mind the things that had sentimental value, like my kids report cards from the start of school, all of my text books, reading books, my encyclopedia’s for my college education. Everything is gone. My storage unit was a 5×10 unit and all that was in it was a few of my clothing and a freezer, bedroom set and some of the things that were recovered from the garbage. Again, is this legal. I have to start all over again, I have no way to prove what was thrown out, I took pics, I don’t have receipts, my tax returns for the last 10 years are gone. I feel violated and I would like to know if what was done was legal. When I went to the super’s house to retrieve my belongings, he had my phone set up in his house. Please advise can I really win a claim against the landlord. I already let the landlord and the super know I would be calling immigration Monday morning on the super and filing my court papers against the landlord,on Monday 7/12/10.
