<p>Father has recently married but is living with wife and 2 other adults in trailer home.</p>
<p>Mother is concerned that Father (and wife) will try to gain sole custody of both children, to save on child support that has been accumulating.</p>
<p>How valid are mothers concerns?</p></div>

I am seeking full custody of my two children they are ages 16 and 14, we have a current joint custody order in place since 1999, but their father has not played an active role in their lives. He does no call, does not pay ordered child support, and frankly doesnt care. When  I called him to tell him that I was going to file for full custody he said fine but I will fight you. Now this is a man who is remarried, doesnt visit, call, provide any support or play an active tole in either kids lives. My oldest son tried having a relationship with his father and now he is in a youth center because he got charged with posession cause his step mother gave him a controlled substance and she admitted to that and did jail time herself. My daughter which is the youngest hasnt seen her father in 2 years and if she calls to talk to her grandmother (her father lives with his mother) then he just says oh your mom is brainwashing you but he never comes to see her or anything. and since our oldest son has been in a youth which is since last July his father has not called him, written or visited him. I am remarried and have been for almost 10 years my husband has been caring for my children since day one just like they were his own.  My ultimate goal is to have my husband adopt them he loves them and they love him. God forbid something happen to me I wouldnt want my children to b stuck living with their biological father. He has been in and out of jail, is an alcoholic and abuses drugs and has had gang affiliation in the past. He has no job and no financial means his home is in disarray and is not suited for children to b there. I am wanting to insure my childrens future I should have done this a long time ago but I want to get it taken care of before my oldest child comes back home. Perjury-opposing attorney to presiding judge in order to prolong the case</p>
<p>Briefly, after a 6 year court fiasco and 75 court appearances I have found the family courts in Oklahoma to be corrupt. It seems my only alternative is to take it out of the family to the federal court. I now have the funds to pursue this action for any lenght of time.</p></div>

<div>Wondering what to do in a situation where my 15 year old son has become a very very uncontrolable child who thinks he runs the rules in my home.  My husband and I do everything we can to try to disipline him but when we do that according to my son, we are no good parents, etc;. So recently my husband was yelling at my son for getting straight F&#8217;s on his report card and his behavior in school. And my son made a comment to my husband &#8220;I wouldn love for you to hit me because I&#8217;ll hit the lotto&#8221; which he learned to say from my father whom I do not speak to and my parents do not like my husband of 14 years.  So needless to say son calls police saying my husband is threatning him, police show up, and report case to DYFS.  My son has been treating my husband, who has raised him since he was born, very horrible and saying things that are actually heart breaking. So now I have DYFS barking up my family and they have already in 4 days violated my hippa rights. So now my son is staying with my parents because thats what he has wanted because they buy him everything he wants and spoil him rotten.  We do as much as we can for my son with the income we have but its just not enough for him, so now he is making false allegations about verbal and physical abuse hoping he will be able to live with my parents permanatly. And he has my parents telling him things to say to make his wish come true.  So I am besides myself right now because I love my son with all my heart and its killing me to see what he is doing.</div>

<div>the father of my unborn child does not want to be a part of the babys life. i am fine with that and do not care about child support. with living in tx i am worried that we will not be able to make this happen before the baby is born. is there any legal way that we can do that? he is wanting me to say that i do not know who the father is and i know that is a lie and do not want it to come back to cause me issues in the future. i also want to be assured that he can not change his mind adter the baby is born.</div>

<div>I live in San Diego California. When my daughter was born in 2006, I had the father put on the birth certificate and hyphenated her last name (mine-his). Soon after she was born, he rarely ever saw her, was on drugs etc. I then gained full legal and physical custody. He did not show up to mediation for that (he attended via phone) and didn&#8217;t show up to the court date- I was granted full custody. He saw her one last time in December 2007. Not a single time in 2008. Twice in 2009 because I paid for it, and once in 2010 (again I paid for it). He rarely ever calls, does not send me any money (I do not have a child support ordered by the courts). I want to change her last name to only mine, no more hyphen. She is 5 years old and she identifies with me. I know this will make it easier for her, and she knows herself as my last name. Because by law I had to serve him with notification, now he wants to show up and fight the name change. What do you think the chances are that a judge will not grant the name change? I am not sure that he really will show up, but should I spend thousands of dollars on a lawyer, or do you think it will be clear to the judge that this is what is best for my daughter?</div>

<div>Here&#8217;s the situation:</p>
<p>Husband was convicted of sex crimes against teenage step daughter and got 10yrs because of numerous perjury charges, etc&#8230; (the story is too complicated to post, it can be said he dug a very deep hole for himself). He is currently on probation and his time will be up next year. Husband and wife divorced right after he went to prison.</p>
<p>Extended Family situation:</p>
<p>Ex-Husband has 4 children from 1st marriage, all adults now living on their own. Wife has 3 children from 1st marriage, also all adults now including the victim above which are living on their own in other states and locations. Then there is the youngest child, a daughter, which the two have in common, now 16 (she was 7 at the time and was determined not to have been involve) living with the wife of course.</p>
<p>The Problem,</p>
<p>As a condition of the sentencing, a permanent criminal no contact is in place until 2055, expires the ex-husband&#8217;s 100th birthday. This prevents the common child of the couple from seeing her other half siblings, her father (the sex offender mentioned), her paternal grandparents, etc. because apparently (according to his Parole officer, and the order wording) it would violate the no contact order since she is considered the &#8220;victim&#8217;s family&#8221;, and he would be charged with another felony. </p>
<p>As a consequence, this denies the common daughter from ever meeting her father in this life time, even after she is an adult. It also prevents any contact between the ex&#8217;s for their lifetime, which prevents any closure to this situation. </p>
<p>There is no fear of retaliation from him by any of the person&#8217;s involved, the court put the order in place on it own. He is a one time offender, was determined to be low risk of re-offending, and been through sex-offender treatment, and rehabilitation, etc. </p>
<p>How is it fair that he can see &#8220;his&#8221; side of the family, but not the common daughter? The court did not consider the collateral damage when they put these measures in place.</p>
<p>The question:</p>
<p>What can be done to remedy this situation (after the child turns 18)? She has a lot of anger and issues over not being able to see her father, ever, and her other siblings. Is there is any legal recourse that can be taken?</p></div>

<p>It appears that my 17 year old daughter has been asked several times by her father to babysit her 7-month old stepsister.<br />
I am VERY worried that if something should happen to the infant my daughter (as responsible as she is) could face an array of consequences, from emotional to legal.<br />
From a legal standpoint, what could happen to her if, god forbid, some freak accident should happen to the baby?</p>
