My wife failed her last semester of her RN class. She passed all tests but one and also passed her HESI exam (which is what the college uses to measure the students ability to pass state boards). Obviously, she appealed her grade. The instructors reviewed each test after completion, made adjustments, sent out rationales for changes and the testing ended with the final. At that point, several others began appealing the test that my wife failed (a large percentage of the class failed this same test). The instructors went back again and adjusted some grades on at least two tests and declared these same tests “thoroughly reviewed” again. Thankfully, this caused many others to pass, but put my wife literally one question away from a passing grade. She appealed again to the department chair. (but my question is not directly related to this)

Meanwhile, to be a good sport, my wife decided to help assist with the pinning ceremony practice of the passing students. When she arrived, she was approached by the department chair, who asked her name. My wife told her and the department chair promptly told her that she could not be there. My wife explained that she wasn’t there as a participant, but rather to assist as needed. The department chair again told her that she needed to leave.

My wife has trouble being admonished by authority figures. She is a very capable LPN and has won many accolades for her work. This event, couple with her near miss, upset her emotionally. So badly, that while at the doctor’s office later that day (pre-made appointment for reupping some meds), the doctor told her that she did not need to work in the state that she was in and gave her a doctor’s excuse for the remainder of the week. So she missed work due to this. (But, it gets better)

Now -for the pièce de résistance:

Later that everning, the department chair replied using the appeal email that my wife sent her, with this explanation:

“Mrs. Xxxxxx, As I told you in the hall at the Xxxxxx Annex, there are policies in place which guide any decisions I make. I am unable to waive the Pinning and/or Graduation policy for students who have not successfully passed the exit HESI. Dr. Xxxxxxx”

Contained in that very same email are these first three sentences from my wife:

Dr. Xxxxxxx,
I do appreciate the extra points. I ask that Test 1, Test 3 and the Final be examined as well. I am appealing my grade. Again, I state my reasoning – having passed the HESI test which is the major bench mark our school measures our future nurses and their success.
This seems to highlight a few things:

- My wife was removed without merit
- The department chair apparently didn’t give my wife’s appeal any merit at all
- The department chair is not capable of checking her facts prior to issuing an email.

So- my question. Is there a legal case here? I know that at the very least this is a moral injustice, but would it be legally? If so, what is the best approach?

I don’t pretend to be a lawyer, and we have never sued anyone in our lives (we are in our late 40′s), but this seems very wrong.

A dentist I had visited a while back had sent me a “balance forward” statement 3 years after the last data of service, immediately followed by a completely erroneous itemized bill and an unauthorized charge on one of my credit cards within their file for the amount stated on their bill.
At the time of the treatment, all the out-of pocket expenses were verbally negotiated and paid up front.
It took me months to clean this up and get the charge to be reversed on my credit card.
One year after this incident, the doctor had filled a lawsuit against me seeking payment for this factious billing. I had to show up three times in court, to answer the complaint, once the case was adjourned as the plaintiffs attorney had filled for application and for the trial itself. The judgment was in my favor and did not have to pay a dime.
I had a lot of patience, did not hire an attorney and went through all this on my own … after all this was over, I concluded that at least I could post a review against this doctor about the negative experience I had with him, which I did.
Among others I had mentioned that this doctor will persuade you for unnecessary treatment, that this billing records are a mess and his unprofessionalism will make you sick to your stomach. My user id was my first name, my last initial. A week later there was a comment posted under my review by the plaintiff’s attorney advising me to take my defamatory statements somewhere else and that I would be a happier person if I would’ve paid my bills!
In the meanwhile I have removed my review, just because I don’t want to hear anything from this doctor, nor his attorney … he had mentioned “defamation”, so I was worried that they could file a lawsuit on this ground. Is this possible? Can we even post a review now days and which are honestly describing what I had to go through?

I was romantically involved with a pro athlete for three years unaware he was married. within this three years there were promises, abortions, and also an tube pregnancy which cause me to almost lose my life along with an emergency surgery that I now still have health problems from and can not afford to see the doctor. this was a serious relationship (so I thought) I changed my plans on moving and based a lot of things on what he said and the state of our relationship which has now caused me to be in a bad position financially. He is now harrassing me and treating me. Do I have a legal argument???

My name is Mary-Katherine. I am seeking legal advice for a missed court date for a supposed second DUI. I believe the case itself will probably get dropped once I can finally get in touch with the Harrison County Court system.
I was in Twelve Oaks facility voluntarily for my court date and I believe the attendants and therapists tried to send or fax proof to them. I did later as well and never received any response.
I am planning to get all of my papers together and go fax them again, or just bypass it and walk in with my papers.
The DUI charge was about my prescription medicine that was for therapeutic doses. I had taken one dose of the medicine for anxiety at work before lunch. Soon, they cut me because it was quite slow. Upon leaving, a US Post Truck stopped abruptly and we bumped each other. Police were called and upon seeing my prescription they took me into custody and I complied to a blood test.
I was not aware that the medicine Adavan was bad to take while driving. It didn’t even say it on the label. Unfortunately I no longer have the bottle but I can get a letter from my Doctor explaining my anxiety. I was also on an anti-depressant Abilify that I was soon taken off of because it was causing Tardive Dyskinesia: i.e. twitching and shaking involuntarily.
I am wondering since I was not on any illegal drugs or anything unprescribed, what are my best choices?

My husband and I had a thallium stress done on March 16, 2011. Our physician was not present during the testing. Several things went wrong including wrong patient scheduled. During my husbands exam, he explained to technician that he has rods in back and is unable to walk on treadmill. Tech was more concerned about him finishing test than about him. When he ask her if he could step off on the side, as he was literally holding up his leg with his hand and moving it, she told him he had to finish the test. He told her he may fall. After 2nd round of xrays were taken, he had to roll off table. His back locked up which causes severe pain in siatic nerve. He could not put pressure on left leg. He was on knees next to counter top of desk. Five techs walked by and never checked on him. The echo tech walked by and stopped to ask him if he was ok. He told her NO. She turned around and left him there. He received no assistance at all to help him get up or evaluate him for injuries. During my procedure, they kept asking me what was wrong with him. When I told them what happened they said “I can’t see her not doing chemical on him. She is good at that.” On my behalf, I have lung disease. The physician I saw had placed me on coreg. It has caused increase shortness of breath requiring more frequent use of rescue inhaler, low heart rate in 40′s, severe dizziness which I require assistance and severe headaches. COREG, when I searched it, has a warning not to use in patients with lung disease such as asthma, emphysema. I have asthma, bronchiectasis (not bronchitis), emphysema. I called cardiologist office and ask nurse to have doctor call me. We had test done 2 weeks ago and hadnt heard any results.nurse said stress test was “normal” which is great. Left ventricle is good….my issues is with RIGHT sided heart failure. When I questioned her, and told her I havent had a “normal” stress test in the past 3 test, she said it doesnt show anything about right side of heart. If my heart is normal, why am I on a alpha-beta blocker? She asked me who put me on it!!!! Then she ask me if I was sure I saw their doctor!!!! When I told her I wanted doctor to return my call. She informed me SHE was his nurse and SHE returns his call. I asked her why he wasnt present during thallium stress test and she told me he was out of office. I have had 3 thallium stress test. All of which shows thickening of right ventricle. I have history of TIA’s. After a slightly heated conversation, she told me he will call me. As of now, he hasn’t. Is this considered incompetent on the doctors part as well as the staff? Thank you for your time.

Doctors nurse just called me back and said Doctor tried to call a few mins ago but my phone was disconnected…well, how did she reach me on it??? Told me he said I could stop COREG. I asked her how did he want me to taper my dose as I cant just cold turkey this medication. She replied….He didnt say you had to taper it, just stop taking it. She then told me she would have to ask him about tapering the dose. Geesh…..did they go to medical school??? I don’t think I will be using their office for my cardiac services. Any opinions on this? Thanks again.

Long story short, my mom who is now 84 years was asked by my nephew to co-sign a student loan about 8 years ago. His father, my brother has been divorced from his ex wife for about 10-15 years now. My mother wasn’t exactly thrilled, but she figured he was smart and co-signed. A few months later her ex daughter in law came to mom’s house and told her she needed to sign more papers for student loan. My mom went and signed the papers. She later found out through creditors that she had also co-signed two additional student loans, one for her other grandson from this marriage and one for her ex daughter in law.
Today my mom was just served papers concerning one of these loans. She has been harrasssed for the last 3-4 years and in just the past year it has really stressed her out, so much that even her Doctor asked her about what is causing her health to suddenly deteriorate. I contacted Federal Administration on Aging and they gave me a legal aide number, but I am unsure how much they will be able to help. I feel this was elder abuse, but mom is too proud to admit this. I have researched and Bankruptcy won’t help her. She was not told too many details of these student loans after her initial signature, we believe any signature later were most likely forged, she also thinks the loans were private, not federal. We live in California, so would this be a route to pursue, since the Statute of Limitations does apply to private student loans (I think). She has spoken to the legal aide, but is waiting for more information, but they did ask if she could make small payments, which on social security, no she can not afford this. The two grandsons are now 25 and 26 and keep changing majors, still in school and unwilling to work. They will not answer her phone calls or letters or from anyone from our side of the family, including their father. Is there any thing she can do?

My fiance was recently falsely accused of sexually molesting my son. The accusers were my ex and his grandmother whom he resides with.

The allegations were proved false.

Can we now sue for defamation of character and emotional distress? I have since had to up anti-depressants and see my doctor for that. The whole ordeal has been extremely exhausting on my family and my kids.

I have a question regarding unemployment benefits. I formerly worked for a company in MA. I am being denied UE benefits by the state of MA b/c of what they claim was left for personal reasons. ( this is not true) I was on a medical leave. I do not know if I need to obtain legal representation in MA or CA.

My health was being severely compromised and my job entails a lot of customer service and using a computer keyboard . My employer would not make special circumstances for me. It was all or nothing. I was seeing the doctor almost every month. Finally, I had to go on medical leave to see if these would dissipate and get better. My husband brought me to CA to spend time with family and I have been here ever since. We had a home in MA, which has since been sold, so we are virtually left w/o a residence. We call CA home right now.

The stipulation for return from a medical leave is that you need to see the doctor upon your return. Since I am here, I cannot do that. My question is this? Do I need to obtain legal representation here in CA or in MA? This is all new to me so I do not know what recourse I have. I have always been upfront with this company. I have never lied about my situation but now feel penalized b/c I have been denied ue benefits, which I feel I should have gotten.

I live in California. I had a prescription for marijuana and it expired. I totally forgot as I have not purchased any for several months. Today I went to my regular store and made a purchase. They asked me for my script and I told them I do not have it which I did not but I was sure was updated. They sold me product but asked me to bring it in on the next visit.

Upon arriving home I called the doctor who prescribed it to me the last 3 years. They looked it up and sure enough it expired back in October 2010. So i set an appointment for tomorrow early am with the doctor. Afterwords I called the store and explained this. I offered to return the product as I never even opened the bag. They said to simply bring in the script when I get it. Any suggestions?
