My 30 year old son has had 2 DUI’s and has had his license suspended for 2 years. He has fulfilled all his court obligations and has been clean for about a year. When he gets his license back, he wants us to give him (or sell real cheap) our old family car so he can look for a job. Since we know his history, if he has an accident while DUI again, will we be civilly or even criminally liable?

I think my case is all kinds of screwed up from the get go and it is just now starting to get straightened out.

My son’s dad and I have previously managed to come up with our parenting arrangements and such either through mediation or offline. The parenting plan was always submitted to the court and approved/ordered. BUT child support has never been court ordered, nor has it ever been sent to the court for approval. My son is 10, his dad & I were never married and have not lived together or had any kind of relationship since he was 18 months. Since his recent divorce he has been pushing everything through the court, new parenting plan, new school for our son, and now a motion to modify child support.

He has always given me a check every month in an amount we have agreed to. The amount was always at least loosely based on the KS child support guidelines. He is supporting his son and has always done so. I’m actually concerned he will be harming himself by taking this before the court. Will they consider the money he has always given me as child support even though it was never court ordered? He gives it to me as a check with the month and “child support for (son’s name)” in the memo line. We’ve always erred on the low end of the child support estimates since I make more than my son’s dad and I don’t live outside my means. I have never relied on the c/s as more than extra money for our son to be able to do extra-curricular activities and I would also pay 100% of his medical costs for most of those costs that way dad’s c/s was never more than he could afford. With my son’s dad’s recent divorce I’m concerned this could impact him negatively when he has said numerous times he cannot afford even the smallest costs not budgeted for already.

Any idea if the court would determine they needed to set up c/s instead of modifying? Or if they would consider what we have done in the past to be the equivalent of court ordered support and only modify for the future?

I live in Los Angeles. I am a defendant in an unlawful detainer case.

I was served with a Notice of Motion to Deem Requests for Admissions Admitted and for Monetary Sanctions (pursuant to C.C.P. Section 2033.280. It indicated that I should appear for the matter to be heard at 9:15 AM on April 25, 2011. Due to a sudden medical situation, I was delayed; I arrived at 9:20. However, by then, the court had already heard and rule on the plaintiff’s motions.

The judge deemed the Requests for Admissions Admitted. Also, I am required to pay monetary sanctions of $150 to plaintiff attorney.

Note that I did call that trial room (department) five times to inform the court of my situation, and that I would be approximately five minutes late. But, each time I got the voice mail; I left the same message each time.

Here are the specific admissions about which I am concerned:

Request for Admission No 1
That [name of my apartment owners’ company] has met all applicable requirements of local rent control or eviction control ordinance.

Request for Admission No 2
That [name of my apartment owners’ company]] does not violate local rent control ordinance, including the posting of Rental Registration statement.

I had planned to show certified Los Angeles Housing Departments (LAHD) documents that indicate that my unit is not registered, notwithstanding the fact that LAHD ordered the landlords to register my rental unit. LAHD did tell me to withhold rent until landlord had complied with that registration requirement. After compliance, I was to pay the current rent, plus any rent past due.

Questions:

1.	Can I file a motion to set aside the court’s decision, and have an opportunity to explain what happened? (If so, what type of motion(s)
2.	If not, what procedure can I use to have the motion hearing ruling reconsidered?
3.	At trial, can I still raise as an affirmative defense the failure of the landlord to register my rental unit?
4.	At trial, can I still raise as an affirmative defense the failure of the landlord to register my rental unit?

——————

Ordinance excerpts:

I hope I am in the right section,if not I apologize in advance.:)

I am trying to petition the court for a delayed birth certificate. I have been through the vital statistics and cannot get any further without the court order, however when I went to the county courthouse to file I was told they did not have the paperwork I would need and I would have to figure it out on my own.
I cannot seem to find the necissary paperwork anywhere. I did find something in Fl statutes that said I must petition the court on a form provided by the department.(Florida statutes Title XXIX public health section 382.001 short title). Since the department doesn’t have it where else can I get it?
I would greatly appreciate any help as this has been dragging on for months.

So here are the questions: (a) is there any way for me challenge this incorrect information, (b) is there some sort of central database that these tenant background search companies pull their information from (maybe Lexis Nexis), and (c) who can I make the challenge to.

I know this is a bit off of the credit topic … but it seems that these companies are completely rogue and outside of the Credit Reporting Laws.

Earlier in the year I received an MIP in Michigan. I was 20 yrs old at the time and it was my first offense. I had spoken with an attorney for advice and she had recommended that since it was my first offense I could apply for a referral program that the court offers to get it taken off my record. I am current on the court referral program (court probation) for one year. My Probation Officer said this is on my private record, meaning no one will know about it except for her & the police. One of my restrictions are that I can’t consume alcohol. Im turning 21 in a few weeks and am wondering if my license will say “restrictions: Alcohol”? Or will it just be a normal license and that information will be given when my id is scanned since my probation is on a private record?

I have 2 mortgages. The first is in modific. process ($200,000) while the 2nd has gone to a collection agency. I lost my job 1.5yrs. ago and my husband is the sole earner(family of 5). Under pressure from coll. agency, I made an arrangement to pay monthly installments that I now see we cannot afford to pay. Can I renegotiate terms to lower payments or do I risk foreclosure by doing so? ( The 2nd mort. is for $50,000). We are already paying on 2 other court judgements for unpaid debt and have 2 liens on our home. Would love to hear your suggestions. Thank you for your time.
